  • Except as permitted by Clause 13.2, the Adjacent Facility Owner shall procure that its Affiliates and its and their respective officers, employees and agents shall keep confidential and not disclose to any person any Confidential Information.

  • Such disputes shall be resolved in accordance with the procedure in Clause 12.2.2. Save to the extent that disputes are so notified, the Adjacent Facility Owner shall be deemed to have agreed the contents of each invoice or statement of amounts payable.

  • Network Rail shall inform the Adjacent Facility Owner of the reasonable costs of any renewals as described in Clause 15.4.4 not later than 12 months in advance of the commencement of these works (with the exception of emergency renewals carried out in accordance with Clauses 15.4.2).

  • If Network Rail or the Adjacent Facility Owner, as the case may be, has not received a request to return any Confidential Information to the other party under and within the time limits specified in Clause 13.3, it may destroy or retain such Confidential Information.

  • Network Rail will notify the Adjacent Facility Owner of any emergency renewal as soon as possible after it becomes aware that such renewal is required.

  • The Adjacent Facility Owner shall pay to Network Rail the reasonable costs as agreed or determined of such emergency renewals, such costs to be paid over a period of [three] years, commencing with the next billing date after both the works have been completed and costs agreed or determined.

  • On-site facility means a structural BMP located within the subject property boundary described in the permit application for land development activity.

  • Common Facilities means the facilities under D.G.sets/D.G.rooms, water storage tanks its pumping and supply system, sewerage & drainage systems, electric sub-station/ transformers/electric panels/distribution network, maintenance service rooms, lawns including lighting & services etc., roads, pathways & driveways including street lighting & services etc., guard posts, fire hydrants & fire fighting system etc. and all such facilities and areas for common use and excluded from the computation of Super Area of the Said Premises;
