AdjudicatingAuthority definition

AdjudicatingAuthority or “NCLT” means the Hyderabad Bench of the National Company Law Tribunal. “Affiliate” with respect to any Person shall mean any other Person which, directly or indirectly:(a) Controls such Person; or(b) is Controlled by such Person; or(c) is Controlled by the same Person who, directly or indirectly Controls such Person. “Applicable Laws” means, all applicable laws, regulations, rules, guidelines, circulars, re- enactments, revisions, applications and adaptations thereto, judgments, decrees, injunctions, writs and orders of any court, tribunal, arbitrator or governmental agency or authority, rules, regulations, orders and interpretations of any governmental authority, court or statutory or other body applicable for such transactions including but not limited to the IBC, CIRP Regulations, Companies Act, 1956 / 2013 (as applicable), Competition Act, 2002, Foreign Exchange Management Act, 1999, whether in effect as of the date of this RFRP or thereafter and each as amended from time to time. “Approved Resolution Plan” means the Resolution Plan, as approved by the CoC in accordance with Section 30 (4) of IBC and as approved by the Adjudicating Authority in terms of Section 31 of IBC. “Associate Company” has the meaning given to it in the Companies Act, 2013. “Authorized Signatoryin respect of a Prospective Resolution Applicant means a person or persons duly authorized by such Prospective Resolution Applicant (to execute the Resolution Plan (and all ancillary documentation, undertakings, letters, certificates, acceptances, clarifications, guarantees or any other deeds or document as may be required), including all amendments and variations thereto and authorized to negotiate the Resolution Plan and provide representations, information, responses, clarifications to the Resolution Professional or the CoC or the Adjudicating Authority, and generally deal with the Resolution Professional, CoC and Adjudicating Authority with respect to the Resolution Plan. “Business Days” means the days when banks are open for business in Hyderabad, Telangana and Mumbai, Maharashtra. “Cash” shall have the meaning set out in Clause 3.1.7 (a). “CIRP” means the corporate insolvency resolution process under the provisions of the IBC. “CIRP Period” means the period commencing from the insolvency commencement date of the company and expiring on the date of order of the Adjudicating Authority, either approving the resolution plan for the Company or liquidating the Company.

  • Competent Body means any body that has authority to issue standards or recommendations with which either Party must comply Conditions Precedent means the conditions precedent, if any, to commencement of service delivery referred to in clause A3.2 (Commencement and Duration) and set out in Appendix B (Conditions Precedent)

  • enforcement authority means any person or body having jurisdiction to enforce or to take action under or in respect of the relevant legal requirement.

  • Commissioners Court means Travis County Commissioners Court.

  • Judicial Authority means any court, arbitrator, special master, receiver, tribunal or similar body of any kind.

  • Court of Appeal means the division of the Supreme Court referred to in section 7(1)(b);

  • Tribunal means any state, commonwealth, federal, foreign, territorial, or other court or government body, subdivision agency, department, commission, board, bureau or instrumentality of a governmental body.

  • Adjudication means agency process for the formulation of an order;

  • Health Care Authority or “HCA” means the Washington State Health Care Authority, any division, section, office, unit or other entity of HCA, or any of the officers or other officials lawfully representing HCA.

  • Tribal Court means a court with jurisdiction over child custody proceedings and that is either a Court of Indian Offenses, a court established and operated under the code of custom of an Indian tribe or any other administrative body of a tribe that is vested with authority over child custody proceedings.

  • Health Authority means the regional health board designated under the Health Authority Act, RSBC 1996, c.180, or the Provincial Health Services Authority, to which the Participant is designated under Section 5.4 of this Contract, unless designated otherwise by the Province;

  • Authority means any governmental, regulatory or administrative body, agency or authority, any court or judicial authority, any public, private or industry regulatory authority, whether national, Federal, state or local or otherwise, or any Person lawfully empowered by any of the foregoing to enforce or seek compliance with any applicable law, statute, regulation, order or decree.

  • Adjudicative proceeding means the procedure to be followed in contested cases, as set forth in RSA 541-A:31 through RSA 541-A:36.

  • Body means any organisation or entity, whether a juristic person or not, and includes a community association;

  • Adjudicatory hearing means a hearing to determine:

  • Appeal authority means the executive authority of the municipality or any other body or institution outside of the municipality authorised by that municipality to assume the obligations of an appeal authority for purposes of appeals lodged in terms of the Act;

  • Government Agency means any government, or any governmental, semi-governmental or judicial entity or authority, including any self-regulating authority established under any statute.

  • former Authority means the Water Authority of Western Australia under the Water Authority Act 1984 2 before the commencement of Part 2 of the Water Agencies Restructure (Transitional and Consequential Provisions) Act 1995 3;
