An Affidavit of Borrower executed by the Borrower certifying to the Lender that there are no tax liens, judgments against the Property or that there has been no labor or materials furnished to the Property within the last 120 days, or that there is no unrecorded documents or parties in possession except as set forth in the Permitted Encumbrances (as defined in the Mortgage).
The term “Security Instruments” shall mean this Loan Agreement, the Deeds of Trust, the Note, the Guaranty (whether one or more), the Financing Statements, and such other instruments evidencing, securing, or pertaining to the Credit Facility as shall, from time to time, be executed and delivered by Borrower, the Guarantor, or any other party to Lender pursuant to this Loan Agreement, including, without limitation, each Affidavit of Borrower, each Draw Request, and the Approved Budget.
Borrower shall have executed and delivered the ---------- Affidavit of Borrower, and Guarantor shall have executed and delivered an Affidavit of Guarantor in form and substance satisfactory to Lender.
Each Draw Request shall be accompanied by the Affidavit of Borrower.
The term "Affidavit of Borrower" shall mean a sworn affidavit of Borrower (and such other parties as Lender may require) to the effect that all statements, invoices, bills, and other expenses incident to the acquisition of the Property and the renovation of the Improvements incurred to a specified date, whether or not specified in the Approved Budget, have been paid in full, except for amounts retained pursuant to the Construction Contract.
