Affiliate Leases definition

Affiliate Leases means any operating lease that is entered into between any Borrower or any of its Subsidiaries, as lessee, and any “related party” (as defined in paragraph 5 of Financial Accounting Standards Board Statement No. 13, Accounting for leases (“FAS13”)) or Affiliate of such lessee, as lessor, that is required to be treated as capital lease obligations under GAAP, pursuant to FAS13, as amended from time to time.

Affiliate Leases means the leases and subleases described on Schedule 1.1A, and all amendments, supplements, restatements or other modifications thereto or thereof as have been previously approved by Agent to the extent required hereunder.

Affiliate Leases means leases for each of the Store properties identified under the heading "Affiliate Leases" on Schedule 3.2.

Examples of Affiliate Leases in a sentence

• The Seller Leases and the Affiliate Leases shall be substantially in the form of Exhibit A hereto upon the terms (including annual rent) identified in Schedule 3.2 hereto.

• The Property is not subject to any Material Leases other than the Affiliate Leases and the Leases described in the certified rent roll delivered in connection with the origination of the Loan.

• To the extent Affiliate Leases are below then current market rates, Seller shall, prior to Closing, enter into replacement leases with such Affiliates on Purchaser’s form of lease at current market rates on a month to month basis.

• The parties agree and acknowledge that the Affiliate Leases will be terminated at Closing and neither the interests, rights or obligations of any Seller (including any Seller Tenant) thereunder will be conveyed or assigned to Buyer.

• If any of the Affiliate Leases are rejected or terminated, the Debtors would be required to vacate the premises, subject to such lease.

Affiliate Leases have the meanings set forth in the Recitals.

Affiliate Leases means each other lease between Landlord or any Affiliate thereof, on the one hand, and Guarantor or any direct or indirect subsidiary thereof, on the other.

Affiliate Leases means Seller's leases with Affiliates for the Affiliate Real Property.

Affiliate Leases means the Leases with Landlord as lessor listed on Schedule 3.10.

Affiliate Leases means that certain lease agreement by and between Hammer (DE) Limited Partnership and Tenant with respect to property situate in Springfield, Oregon and Jonesboro, Georgia dated as of the date of this Lease and that certain lease agreement by and between BOLT (DE) Limited Partnership and Tenant with respect to property situate in Kingman, Arizona, Springfield, Oregon and Fogelsville, Pennsylvania also dated as of the date of this Lease, each as amended or modified from time to time.

Affiliate Leases means those certain leases for non-residential real property, which are set forth on an Exhibit to the Disclosure Statement.
