Approved Cups definition

Approved Cups means the disposable cups approved by Pepsi from time to time as its standard trademark cups and other containers approved by Pepsi from time to time and bearing the trademark(s) of Pepsi and/or other Products. In addition, Pepsi agrees that the Customer shall have the right to produce limited-run commemorative plastic cups reasonably acceptable to Pepsi for use at the Facilities and that such cups shall also be considered to be Approved Cups, provided that Pepsi’s trademark(s) for Pepsi® shall be included on such commemorative cups. The use and size of Pepsi’s trademark(s) on such commemorative cups shall be subject to the prior approval of Pepsi.

Approved Cups means disposable cups approved by Beverage Provider from time to time as its standard trademark cups and/or vessels and/or other (disposable and non-disposable) containers approved by Beverage Provider from time to time, all of which shall prominently bear the trademark(s) of Products (as herein defined) on all of the cup surface.

• All Concessionaires with Beverage operations on Campus will comply with all applicable provisions of the Coca-Cola Agreement, including purchasing their entire requirements for Beverages, cups, lids, and CO 2 from Bottler (except as otherwise permitted under (“Permitted Exceptions”) and using Approved Cups.

• Approved Cups; Product Hawking and Catering.Customer agrees that all Products served, sold or dispensed at concession locations in which Products are served to customers at the Facilities shall be served in Approved Cups and all other Beverages served, sold or dispensed within the Facilities shall be served in either Approved Cups or other disposable cups which do not bear, display or contain the trademarks or service marks of a manufacturer of Competitive Products.

• Permitted Exceptions, to the extent served or sold in cups, shall not be served or sold in Approved Cups.

• University and its third party food and beverage concessionaires ("Concessionaires") will purchase from Bottler their entire requirement for Beverages and Approved Cups, lids and carbon dioxide on Campus except for Simply Orange brand products and Odwalla brand products, which may be delivered directly by Company and/or its distribution partners.

• Contractor agrees to make Approved Cups available to University or its Food Service Provider and University shall itself purchase or cause the Food Service Provider to purchase such Approved Cups only from Contractor, at prices determined by Contractor.

• University further agrees that Products to be ―hawked‖ in the stands shall be sold only in Approved Cups.

• University agrees that all Products served, sold or dispensed at concession locations in which Products are served to University at the Facilities shall be served in Approved Cups and all other Beverages served, sold or dispensed within the Facilities shall be served in either Approved Cups or other disposable cups which do not bear, display or contain the trademarks or service marks of a manufacturer of Competitive Products.

• Pepsi agrees to make Approved Cups available for purchase and the Customer shall purchase, and shall require that all concessionaires, Food Service Providers, booster clubs and other third parties selling Beverages at the Facilities purchase all Products, cups, lids and carbon dioxide directly from Pepsi at prices determined by Pepsi.

• The University shall cause its Food Service Provider to purchase Approved Cups from Contractor for dispensing of Postmix Products at the Facilities.

More Definitions of Approved Cups

Approved Cups means disposable cups the design of which is approved by Sponsor from time-to-time as its standard trademark cups and/or vessels and/or other (disposable and non-disposable) containers approved by Sponsor from time-to-time, all of which shall prominently bear the trademark(s) of Contractor and/or other Products on one hundred percent (100%) of the cup surface.

Approved Cups means the disposable cups approved by Contractor from time to time as it standard trademark cups and other containers approved by Contractor from time to time and bearing the trademark(s) of Pepsi and/or other Contractor Products on the cup service. In addition, Contractor agrees that the University shall have the right to produce limited-run commemorative plastic cups reasonably acceptable to Contractor for use at the Facilities and that such cups shall also be considered to be Approved Cups, provided that Contractor’s trademark(s) for Contractor® shall be included on such commemorative cups. The use and size of Contractor’s trademark(s) on such commemorative cups shall be mutually agreed to.
