Users may apply for Monthly NTS Entry Capacity at a Relevant ASEP for fifty percent (50%) of the Available Monthly Capacity for any Available Month on the first invitation date notified pursuant to paragraph (c)(i) and for the remaining Available Monthly Capacity for such Available Month on the second invitation date notified pursuant to paragraph (c)(i).
Any Available Monthly Capacity remaining after completion of steps (i) through (iv) shall be allocated to the volumes nominated by Committed Shippers to whom notice has been given pursuant to Section 12.02.2 of the TSA.
After the date upon which any such additional rights of such future committed shippers take effect, the allocation of Available Monthly Capacity to Uncommitted Shippers shall be subject to such rights even if such Uncommitted Shippers were allocated more than 10% of the Available Monthly Capacity prior to such date.
The Available Monthly Capacity remaining after the completion of steps (i) through (iii) above, which will be no less than 10% of the total Available Monthly Capacity, shall be allocated to all Shippers (excluding Shippers described in step (v)) with unsatisfied Nominations, pro rata, on the basis of the original Nominations.
During any period when the Available Monthly Capacity is reduced below the annual average capacity, the allocation of such Available Monthly Capacity to Committed Shippers pursuant to step (i) shall be reduced by the same percentage as the reduction in the Available Monthly Capacity.

During any month for which Carrier determines that the Available Monthly Capacity is insufficient to provide Terminalling for the full volume of Petroleum nominated by all Shippers under this tariff, Carrier will, without limiting Rules 4 or 6, communicate such insufficient capacity to Shippers and allocate such volumes in a manner consistent with Carrier’s Available Monthly Capacity.
Subject to Rule 17 (d) and (e), Carrier shall allocate Available Monthly Capacity to transport Crude Petroleum in the following order of priority: Committed Volumes, excluding Make-Up Volumes, to the level of Aggregate Committed Volumes; Committed Shippers’ Make-up Volumes to the extent there is Unused Committed Capacity; Uncommitted Volumes; and Make-up Volumes in excess of Unused Committed Capacity.
