Customer will not be entitled to any remedies set out in this SLA, and the Service Levels will not apply, if Customer does not purchase either (i) Service Select - Extended Service Delivery or (ii) Service Optimize with the Availability SLA option, Capacity Review option, and Guaranteed Time To Repair SLA option (as mentioned in Clause 1.3.1 (Site Availability), Clause 1.3.2 (Path Availability) and Clause 1.7.2 (5-Hour GTTR Conditions), respectively).
The Commissioner shall, upon conclusion of the Capacity Review, report its findings and any recommendations to the Provider.
The Capacity Review shall consider: any constraints on the physical capacity or resources, including Staff of the Provider; and whether the Provider is delivering the most efficient care pathways for the activity the subject of the Capacity Review as informed by Good Health and Social Care Practice.
Where the findings of the Capacity Review are that there is a limit on the activity in excess of the levels set out in the Specification that the Provider can reasonably undertake so as to meet the 18 Week Referral-to-Treatment Standard in respect of a Consultant-led Service, the Provider and the Commissioner shall agree a plan to enable the Provider to comply with the 18 Week Referral-to-Treatment Standard in respect of all such activity as soon as is reasonably practicable.
To conclude that there are adequate environmental safeguards in place, the drafter of the Organizational Capacity Review, in consultation with the Mission Environmental Officer (MEO) or Regional Environmental Advisors (REA) for Mission executed agreements or the Agency Environmental Coordinator or the Bureau Environmental Officer (BEO) for USAID/W executed agreements, must review the PIO’s environmental policies and procedures as part of the Organizational Capacity Review.
The Provider and the Commissioner shall keep under review at every Review held under clause 8 (Review) of this Agreement the findings and recommendations of any Capacity Review, and the progress of any capacity expansion plan implemented under paragraph 4.7 of this Module.
The Provider and the Commissioner shall at all times act reasonably and in good faith in relation to any Capacity Review.
The Commissioner shall commence the Capacity Review within 10 Operational Days of receipt of the said notice.
