As of the Effective Date, Defendant shall not distribute, sell, or offer for sale in California any Covered Product that has been Treated with any Listed Chemical Flame Retardant and which has a Manufacture Date that is on or later than the Effective Date.
Any Covered Products in which the polyurethane foam has been Treated with any Listed Chemical Flame Retardant and which is distributed, sold, or offered for sale by Defendant in California after the Effective Date shall be accompanied by a Clear and Reasonable Warning that complies with Section 3.1.4.
