Class Representative Payment definition

Class Representative Payment means the special payment made to each Plaintiff in their capacity as Class Representatives to compensate them for initiating the Lawsuit, performing work in support of the Lawsuit, and undertaking the risk of retaliation and potential liability for attorneys’ fees and expenses in the event they were unsuccessful in the prosecution of this Lawsuit.
Class Representative Payment means the special payment made to each

  • The Parties agree that the denial, downward modification, or failure to grant the request for attorneys’ fees or expenses or the request for Class Representative Payment shall not constitute grounds for modification or termination of the Settlement Agreement.

  • The Settlement Administrator will pay the Class Representative Payment approved by the Court out of the Gross Settlement Amount.

  • If the Court approves a Class Representative Payment of less than Seven Thousand Five Hundred Dollars ($7,500) for each Plaintiff, the remainder of the unapproved amount will be part of the Net Settlement Amount in accordance with the calculation explained in Section III.D.   • Any Plaintiff who does not execute this Agreement prior to final approval is not eligible for a Class Representative Payment and shall be treated solely as a Class Member.
