Clear and conspicuous means that a notice is reasonably understandable and designed to call attention to the nature and significance of the information in the notice.
Clearly and conspicuously means that a required disclosure is difficult to miss (i.e., easily noticeable) and easily understandable by ordinary consumers, including in all of the following ways:
Conspicuous , with reference to a term, means so written, displayed, or presented that a reasonable person against which it is to operate ought to have noticed it. Whether a term is "conspicuous" or not is a decision for the court. Conspicuous terms include any of the following:
Legend shall have the meaning specified in Section 8.1.
FOIA Notice means a decision notice, enforcement notice and/or an information notice;
Restricted Securities Legend has the meaning set forth in Section 8.2(b).
statutory notice means a notice served by the company under the Companies Acts requiring particulars of interests in shares or of the identity of persons interested in shares.
Sales Notice shall have the meaning ascribed to such term in Section 2(b)(i).
