Competitive Work definition

Competitive Work means employment in the competitive labor market that is performed on a full-time or part-time basis in an integrated setting; and for which an individual is compensated at or above the minimum wage, but not less than the customary wage and level of benefits paid by the employer for the same or similar work performed by individuals who are not disabled.
Competitive Work means work activity that involves in any way: (i) a product in development or commercialized for the treatment of narcolepsy or one of its five recognized symptoms; (ii) a product using sodium oxybate or GHB as an active ingredient; or (iii) a generic version of any Company product.
Competitive Work means the performance of duties and/or provision of services (whether as an employee, independent contractor or otherwise) that are substantially similar to duties and/or services that Executive performed or provided for or on behalf of O&M at any time during the Recent Period. “Competitor” means any person or entity that is engaged in conducting Competitive Business. 6.

Examples of Competitive Work in a sentence

  • During my employment by Merisant and for a period of two years thereafter, I shall not, directly or indirectly, induce or attempt to induce a salaried employee of Merisant Company or any of its Subsidiaries to accept employment or affiliation involving Competitive Work with another firm or corporation of which I am an employee, owner, partner, shareholder, or consultant.

  • In order to protect the trade secrets and confidential and proprietary information of the Company, you agree that, during the Consulting Period, you will notify the Company, in writing, before you perform Competitive Work (as defined herein) for any other business entity.

  • In the event that Executive breaches his obligations under Sections 8, 9, 10, 11 or 12 of this Agreement or in the event Executive performs Competitive Work during the last twelve (12) months of the Severance Period, he shall have no further right to the Severance Pay and Benefits or to the disability pay under Section 6.8, but the release and waiver given by Executive shall remain valid.

  • In addition, for a period of two years following his Resignation Date, the Executive shall not, directly or indirectly, induce or attempt to induce a salaried employee of the Company or any of its affiliates to accept employment or affiliation involving Competitive Work with another firm or corporation of which the Executive is an employee, owner, partner or consultant.

  • During the Transition Period and Severance Period, Executive agrees not to engage in Competitive Work for or on behalf of a Competitor engaged in a Competitive Business in any country in which the Company’s Global Products business unit sold products at any time within the Recent Period (as defined herein).

  • If you engage in such Competitive Work without the Company’s express written consent, or otherwise materially breach this Agreement, then (in addition to any other rights and remedies available to the Company at law, in equity or by contract), the Company’s obligation to pay you Consulting Fees and the Severance Payment (as defined below) will cease immediately.

  • Competitive solicitation means a formal, advertised procurement process, other than an Invitation to Bid, Request for Proposals, or Invitation to Negotiate, approved by the Board to purchase commodities and/or services which affords vendors fair treatment in the competition for award of a District purchase contract.
