The Developer shall ensure that the Construction Works are carried out in accordance with the Concession Specification.
During the Concession Period the Developer shall supply the Grantor's Representative with such information as is required to be provided by the Developer pursuant to the Concession Specification or as may be reasonably required by the Grantor's Representative having regard to the Grantor's statutory duties or the obligations to be performed by the Developer under this Agreement.
The Developer shall be obliged at its own expense to operate and maintain the Toll Road in accordance with the Concession Specification.

For the purpose of this clause no account shall be taken of any increase in operating costs or capital costs of any required Variation which would not have been suffered or incurred had the Toll Road been designed, constructed, operated and maintained in accordance with Good Engineering and Operating Practices and the Concession Specification.
