If Tenant fails to pay the 26672 Contraction Fee within such ten (10) business day period, Tenant’s exercise of the 26672 Contraction Option shall be null and void.
Time is of the essence of delivery of the Contraction Option Notice and the Contraction Payment.

If Tenant assigns this Lease (other than to a Permitted Assignee), then immediately upon such assignment, Tenant's right to exercise the Contraction Option shall simultaneously terminate and be of no further force or effect, No assignee (other than a Permitted Assignee) or subtenant shall have any right to exercise the Contraction Option.
The Contraction Option shall be exercised, if at all, by Tenaxx xxxing notice (the "Contraction Notice") to Landlord in writing on or before April 30, 1998, and simultaneously paying to Landlord a contraction fee of Eight Hundred Four Thousand Four Hundred Eighty Dollars ($804,480.00).
