D elivery definition

D elivery and "Deliver" mean, for each Licensed Software, the earliest of (a) the date that INSOURCE places the Licensed Software with a shipping agent, F.O.B. Shipping Point, for shipment to the Delivery Address or such other address the Licensee specifies, or (b) the date INSOURCE provides the Licensee electronic access to the Licensed Software by, for example, providing the Licensee a URL, where the Licensed Software is available for immediate electronic download along with access codes permitting download and access to the Licensed Software, or (c) the date that the Licensee actually receives the Licensed Software.
D elivery means delivery in compliance of the conditions of the contract or order.
