Damage Threshold definition

Damage Threshold has the meaning set forth in Section 10.4.
Damage Threshold shall have the meaning set forth in Section 11.5(d) of this Agreement.
Damage Threshold means the amount specified in Part I, point 16 of the Purchase Agreement. Delivery means the transfer of title of the Aircraft by Seller to Purchaser hereunder. Delivery Adjustments means the financial adjustments to the Purchase Price calculated in accordance with Part I, point 11 of the Purchase Agreement.

  • This Annex shall be for the purpose of NASA WSTF to perform a Visual Damage Threshold (VDT) testing for ARDE, Inc.

  • A substantial portion of the Real Property shall be deemed taken if the area of such portion, as reasonably determined by Buyer and Seller, exceeds the Damage Threshold (defined in Section 8.2 below).

  • Buyer shall have the option, within ten (10) days after receipt of written notice of a loss costing more than the Damage Threshold to repair or cure, to either terminate this Agreement or to purchase the Property notwithstanding such loss, but without deduction or offset against the Purchase Price.

  • If the Premises or the Building is substantially or totally destroyed by any cause whatsoever which is not covered by the foregoing provisions of this Paragraph 13, this Lease shall terminate as of the date the destruction occurred; provided, however, that if the damage does not meet the Landlord Damage Threshold, Landlord may elect (but will not be required) to rebuild the Premises at Landlord’s own expense, in which case this Lease shall remain in full force and effect.


More Definitions of Damage Threshold

Damage Threshold means the amount specified in Part I, point 16 of the Purchase Agreement.
Damage Threshold means pattern like cracking (combined horizontal and vertical), in the wall of a dwelling house, mentioned in the second defect set out in the key to Figure 2 of I.S. 465:2018 on at least one elevation, externally or internally, in which a crack width equal to, or greater than, 1 millimetre is present;
Damage Threshold means the greater of (a) sixty percent (60%) of the market value of the Hotel immediately prior to the time of fire or other casualty, or (b) the amount of insurance proceeds made available to Franchisee in connection with the fire or casualty. If the damage or repair requires Franchisee to close all or any portion of the Hotel, then Franchisee must commence reconstruction as soon as practicable (but in any event within four (4) months) after closing the Hotel and reopen for continuous business operations as a Hyatt Place Hotel as soon as practicable (but in any event within twenty-four (24) months) after closing the Hotel, but not without complying with this Agreement’s other terms and conditions (including the applicable provisions of Article II). If the cost to repair the damage from a fire or other casualty exceeds the Damage Threshold and Franchisee either fails to notify Hyatt within a reasonable time after the casualty that it intends to repair the damage and operate the Hotel as a Hyatt Place Hotel, or notifies Hyatt that Franchisee elects not to repair the damage and operate the Hotel as a Hyatt Place Hotel (including if Franchisee elects to repair the damage and re-open a hotel at the Site under a name other than “Hyatt Place”), then Hyatt may terminate this Agreement and Franchisee must pay Hyatt liquidated damages pursuant to Section 16.5. However, if a hotel is not reopened at the Site (either as a Hyatt Place Hotel or under any other brand) during the twenty-four (24)-month period after closing the Hotel, then the amount of liquidated damages payable pursuant to Section 16.5 shall not exceed the amount of any insurance proceeds that Franchisee receives. Franchisee must provide Hyatt such documentation as Hyatt may reasonably request to calculate the Damage Threshold and the insurance proceeds Franchisee receives in connection with any fire or other casualty.

Damage Threshold means the minimum amount of total economic damage a landfalling hurricane is estimated to have caused in the county or region that experienced landfall first, as estimated by Eqecat, Inc., necessary for HuRLOs for the particular county or region to be subject to automatic exercise and settlement. The Damage Threshold for each HuRLO county or region is$1,000,000.00. If the Damage Threshold is not met or exceeded, trading in the then suspended HuRLO series may resume, as provided in the HuRLO contract specifications.
