Any change from an approved Decision Request shall be subject to the procedures specified in Section 2.3. A Decision Request may not be used to materially change the services that are the subject of a Work Statement, instead a Change Request must be used and such Change Request shall be subject to the procedures specified in Section 2.3.
In the event ViewRay does not deliver to PEKO a written response to the Decision Request within the period specified in the Decision Request notice, PEKO shall be entitled to act as if ViewRay had responded by not approving the action contemplated by the Decision Request.
ViewRay shall respond to each Decision Request notice within the period of time specified in the Decision Request notice (not to be less than three (3) Business Days nor more than five (5) Business Days).
PROTEON shall respond to each Decision Request notice within the period of time specified in the Decision Request notice (not to be less than one (1) Business Day nor more than two (2) Business Days after PROTEON has received from LONZA the Decision Request and the requisite documents, data and development paths).
Any change from an approved Decision Request shall be subject to the procedures specified in Section 3.4. If PROTEON’s decision on a Decision Request affects the * CONFIDENTIAL TREATMENT REQUESTED.
When making a Decision Request, LONZA shall provide PROTEON with written notice that includes a description of the approval that it is seeking and copies of the requisite documents, data and development paths to which such approval relates.
In the event no written response is received from the Customer by the specified deadline, MCIS shall be entitled to act as if Customer had responded by approving the action contemplated by the Decision Request and such approval shall be deemed given, unless a decision request will or is likely to include additional direct cost to Customer, in which case, written Customer consent shall be required, and not deemed given, and Customer shall respond to such request for consent in a timely manner.
Each Decision Request shall set forth the additional cost to the Customer and effect upon the delivery of Services, if any, of the proposed Decision Request, shall require a response from the Customer during a reasonable and specified period of time not to exceed ten (10) Business Days.
Where Customer withholds its consent, MCIS shall not be liable for any loss, claim or effect in performance arising directly or indirectly from Customer's failure to approve a Decision Request.
Any change from an approved Decision Request shall be subject to the procedures specified in Clause 3.5(b)-(c).
