Upon payment of its fees and any other sums owing to it under this Deed of Trust, Trustee shall reconvey the Mortgaged Property without warranty to the person or persons legally entitled thereto.
At any time or from time to time, upon an event of default, without liability therefor and without notice and without affecting the liability of any person for the payment of the indebtedness secured hereby, and upon written request of Beneficiary, payment of its own fees and presentation of this Deed of Trust, Trustee may: 7.1.1 Join in any subordination or other agreement affecting this Deed of Trust or the lien or charge thereof; or 7.1.2 Reconvey, without warranty, all or any part of the Property.
Notwithstanding anything contained in this Deed of Trust, Trustee (including any successor of Trustee) shall have the power of sale under this Deed of Trust in lieu of Beneficiary, and all references in the Deed of Trust to Beneficiary having a power of sale shall refer instead to the power of sale in Trustee.
If Trustee is named as a party to any civil action as Trustee in this Deed of Trust, Trustee shall be entitled to employ an attorney at law, including himself if he is a licensed attorney, to represent Trustee in such action and the reasonable attorneys’ fee of Trustee in such action shall be paid by Beneficiary and added to the Obligations secured by this Deed of Trust and bear interest at the rate provided above for sums due after default.
In addition to the right provided in Section 6.3(a) of this Deed of Trust, upon, or at any time after the filing of a complaint to foreclose this Deed of Trust, Trustee and Beneficiary shall be entitled to the appointment of a receiver of the Property by the court in which such complaint is filed, and Grantor hereby consents to such appointment.
