Deep Rights definition

Deep Rights means (a) with respect to the Commonwealth of Pennsylvania, those subsurface depths that are below the base of (but excluding) the Xxxxxxx Sandstone Formation (Base of Elk Sequence) formation at a measured depth of 2,758’, as identified by the Litho Density Compensated Neutron Array Induction Temperature Log dated June 7, 2005 of the Seneca Resources operated Fee PGS SGL Xx. 00 (XXX 00-000-00000) xxxxxxx xx Xxx Xxxxxx, Xxxxxxxxxxxx, (x) with respect to the State of West Virginia, those subsurface depths that are below the base of (but excluding) the Xxxxxxxx Formation (Base of Elk Sequence) formation at a measured depth of 6,612’, as identified by the Litho Density Compensated Neutron Array Induction Temperature Log dated October 8, 2008 of the EXCO – North Coast Energy, Inc. operated Wentz 4HS (API 47-001-02982) located in Xxxxxxx County, West Virginia, and (c) with respect to the State of New York, those subsurface depths that are below the base of (but excluding) the Genesee Formation at a measured depth of 2,548’, as identified by the Density/Neutron, Gamma/Temperature Log dated May 6, 2005 of the Fortuna Energy, Inc. operated Xxxxxx-Xxxxxx #1 well (API 31-107-23185) located in Tioga County, New York, recognizing that actual depths will vary across the AMI Area.
Deep Rights means all formations or intervals below either (i) the base of the Fort Union Formation or (ii) 3,000 feet below the surface of the earth, whichever point is closest to the surface of the earth. The depth at which such reservation shall commence shall be determined on a Lease-by-Lease basis. For purposes of this Agreement, the termShallow Rights” means all formations or intervals between the surface of the earth and either the (i) the base of the Fort Union Formation or (ii) 3,000 feet below the surface of the earth, whichever point is closest to the surface of the earth. For purposes of this Agreement, the term “the base of Fort Union Formation” means the stratigraphic equivalent of that formation found at the depth of 2,995 feet measured depth for the Induction Electric log for the Diamond Oil & Gas-Conoco Federal No. 2 well located in the southwest quarter of the southeast quarter of Section 14, Township 47 North, Range 75 West, 6th P.M., Xxxxxxxx County, Wyoming.
Deep Rights means all intervals, formations, strata and depths located below the subsurface depth which is the stratigraphic equivalent of the base of the Cotton Valley Sand Formation, (i) with respect to the Raintree-Loco Bayou Field, being the correlative measured depth of 14,303 feet on the electric log of the Xxx Xxxxx/Encana #3 X.X. Xxxxxxxx well, located in the X. Xxxxx Survey, A-201, Angelina County, Texas, (ii) with respect to the Naconichie Creek Field, being the correlative measured depth of 13,245 on the electric lob of the Xxxxxxxx #2 Xxxxxxxxxxx well, located in the X. Xxxxxxx Survey, A-501, Nacogdoches County, Texas, (iii) with respect to the East Gates Field, being the correlative measured depth of 13,543 feet on the electric log of the Amoco #1 X.X. Xxxxxxxxx well, located in the X.X. Xxxxx Survey, A-645, Angelina County, Texas, and (iv) with respect to the Xxxxxxx-Xxxxxxxxxx Field, being the correlative measured depth of 10,020 feet on the electric log of the Xxxxxxxx #2 X. Xxxxxxx well, located in Section 15-T14N-R16W, Caddo Xxxxxxx, Louisiana.

Examples of Deep Rights in a sentence

  • Buyer or Seller (as applicable) shall have thirty (30) days after receipt of the offer to notify the other Party in writing of its intent to acquire the Shallow Rights or Deep Rights (as applicable) in such Renewal Lease.

  • Failure to respond within such time period shall constitute an election not to acquire the Shallow Rights or Deep Rights (as applicable) in such Renewal Lease.

Deep Rights means those subsurface depths within the East Texas/North Louisiana Area that are below the base of (but excluding) the Cotton Valley formation at a measured depth of 9,650’, as identified by the Jonesville North A-17 well, API No. 42203343000000, recognizing that actual depth will vary across the East Texas/North Louisiana Area.
Deep Rights shall have the meaning given to that term in the Joint Development Agreement.
Deep Rights means all rights of the Debtor or any of the Subsidiaries with respect to their interests, including working interests and rights under applicable operating agreements, in the Deep Dindal association agreement, including the Escuela 2 well.

Deep Rights means all of the right, title, interest and estate, real or personal, recorded or unrecorded, movable or immovable, tangible or intangible, in and to the Assets described in the CBM PSA, insofar and only insofar as the Assets cover, apply to or relate to solely and only those depths: (A) in the Spyglass Hill Unit below the stratigraphic equivalent of the base of the Mesaverde Group, which occurs at a depth of 3,346 feet as found on that certain Gamma Ray/Induction/Density log on the Federal 1691 8i Well located in the SE/4 of Section 18, T-16-N, R-91-W, Carbon County, Wyoming; and (B) in the Catalina Unit below the stratigraphic equivalent of the top of the Trout Creek Sandstone (Xxxxxxxx Sandstone), which occurs at a depth of 2,810 feet in the Cow Creek Unit No. 13-7A Well located in the NW/4SW/4 of Section 7, T-16-N, R-91-W, Carbon County, Wyoming. A schedule and list of the Assets covering the Deep Rights in the Spyglass Hill Unit and the Catalina unit, subject to the depth limitations described above, is attached hereto as EXHIBIT “A” and incorporated herein for all purposes by this specific reference.

Deep Rights means those unlimited drilling rights below 2,500 feet from the surface of the earth or 100 feet below the base of the stratigraphic equivalent of the base of the tertiary age coal formation, whichever is deeper. Such option shall be exercisable with thirty (30) days advance written notice and shall close on the date identified in such written notice or other mutually agreed upon date at which time the leases shall be tendered, ready for recording and the total purchase price shall be due and payable. If such leases ("Presently-Owned Leases - Deep Rights") otherwise conform to the terms, conditions and other provisions of this Agreement, Pennaco shall purchase at least 60% of such Presently-Owned Leases - Deep Rights tendered to Pennaco. For purposes of this paragraph, "60% of such Presently-Owned Leases" shall mean a 100% of an undivided interest in 60% times the total number of acres described in such Presently-Owned Leases tendered to Pennaco. For example, if 20,000 acres are otherwise properly tendered Pennaco shall purchase 12,000 acres.
