Design Contingency definition

Design Contingency means an amount to allow for continued development and completion of the Drawings and Specifications which are not reasonably inferable except for material changes in scope. Amounts attributable to clarifications, assumptions, and further development and completion of the Drawings and Specifications shall be specified in an itemized breakdown. Any unused Design Contingency twenty-one (21) days after the issuance of one hundred percent (100%) CD shall be added to Owner’s Contingency.
Design Contingency means funding identified to address unanticipated costs associated with services provided by design professionals.
Design Contingency means a percentage of the total cost of construction that may be applied to “Additional Services” due to the AOR. This contingency does not apply to reimbursable consultants or expenses.

Examples of Design Contingency in a sentence

  • If the Consultant characterizes the Design Issue as a Project Co Design Issue, the Consultant shall issue a Supplemental Instruction and the cost, if any, of implementing the acceptable resolution to the Design Issue shall form part of the Project Co Design Contingency.

  • The Owner shall have absolute control over transfers to and from the Design Contingency as well as the release of the contingency.

  • The costs of such illustrations and models shall be paid from the Design Contingency.

  • The amount of any balance of Design Contingency shall be confirmed by the written certification of Design-Builder to the Owner at each review.

  • The Design Contingency shall not be increased for any reason (other than by a Change Order in Owner's sole and absolute discretion).

  • Estimates shall set forth in detail Design-Builder's estimate of design and construction costs, including all Actual Costs, Design Contingency, Construction Contingency and Design Builder Fees, for the construction of the Project and each Component thereof.

  • No claim shall be made for any Design Contingency costs or Construction Contingency costs in excess of the established contingency account plus and adjustments as specified in Paragraph 4.4.6.1 above by Design-Builder for any reason, including a default by Owner, or payment of additional compensation to Design-Builder, or any other circumstance which would otherwise permit an increase in the Guaranteed Maximum Price under a GMP Change Order.

Related to Design Contingency

  • Contingency means the identified and possible or already occurred fault of an element, including not only the transmission system elements, but also significant grid users and distribution network elements if relevant for the transmission system operational security;

  • contingency fee means any payment or other compensation that is contingent upon or is calculated upon the basis of a degree of success in soliciting or obtaining a Government contract or negotiating the whole or any part of its terms;

  • Design flow means the average annual flow or average daily flow specified in an approved facilities plan or approved plans and specifications, the flow specified in a WPDES permit, or the flow required to meet performance standards.

  • National Contingency Plan or “NCP” shall mean the National Oil and Hazardous Substances Pollution Contingency Plan promulgated pursuant to Section 105 of CERCLA, 42 U.S.C. § 9605, codified at 40 C.F.R. Part 300, and any amendments thereto.

  • Design Change is a change in work and/or materials shown in the Schedule of Items and described in Plans or specifications that has been mutually agreed to in writing or ordered by Contracting Officer. Changes of a minor nature (such as adjustment in horizontal and vertical alignment, that do not exceed specified tolerance, necessary to maintain or balance earthwork quantities substantially as designed) and variation in quantities, as described in B5.251, shall not be considered Design Changes.
