Discount Department Store definition

Discount Department Store shall include, without limitation, the Persons listed on Schedule 1.2 hereof as well as all department stores which are similar to Discount Department Stores in terms of market niche, size and product pricing which now or hereafter may exist.
Discount Department Store means a discount department store or discount store containing more than 12,000 square feet of building space used for the purpose of selling a full line of hard goods and soft goods (e.g. clothing, cards, gifts, electronics, garden supplies, furniture, lawnmowers, toys, health and beauty aids, hardware items, bath accessories and auto accessories) at a discount in a retail operation similar to that of Retail Tenant. “Drug Store or Pharmacy” shall mean any facility or business that sells or dispenses drugs for which a prescription is required, filled by or under the supervision of an on-site or off-site pharmacist, but shall not include medical doctors’ offices that, ancillary and incidental to the conduct of a medical practice, fill prescriptions on-site only for their patients. This Section shall not be construed as prohibiting the operation of one or more Category Retailers on the Developer Tract. “Category Retailers” are retailers selling primarily a single type of merchandise such as electronics, or apparel, or shoes, or sporting goods, or office supplies or appliances. In no event shall any Occupant that operates a pharmacy or a Grocery Store be considered a Category Retailer.
