In completing the Template Contract Order Form, Customers must ensure that they are act in compliance with DPS Schedule 5 (Contract Procedure) and the provisions of Regulation 33.
Subject to any rights of the Customer under this Contract (including in respect of an IPR Claim), any claims by a third party where an indemnity is sought by that third party from a Party to this Contract shall be dealt with in accordance with the provisions of DPS Schedule 20 (Conduct of Claims).

For the purposes of this DPS Schedule 5, “Guidance” shall mean any guidance issued or updated by the Authority from time to time in relation to the Regulations.
User accepts the designated area in the order and condition that exists as of the beginning of use and agrees to maintain the designated area in the same order and condition except for reasonable wear and tear arising from the use of the designated area under this Agreement.

The purpose of this Part A of DPS Schedule 2 (Services and Key Performance Indicators) is to set out the scope of the Services that the Supplier shall make available to all Contracting Bodies under this Dynamic Purchasing System Agreement and to provide a description of what the Services entail together with any specific Standards applicable to the Services.
