Duplicate Claim definition

Duplicate Claim means a Proven Affected Unsecured Claim against more than one of the Participating CCAA Parties based on the same underlying data or obligation;

Duplicate Claim means a Proven Affected Unsecured Claim against more than one of the Sears Canada Entities based on the same underlying obligation;

More Definitions of Duplicate Claim

Duplicate Claim means a Claim identified by the Monitor as prima facie duplicative of another Claim filed by a Creditor in respect of which the Monitor has sent a Notice of Revision or Disallowance disallowing the Claim for voting and distribution purposes.

Duplicate Claim means any Claim with respect to which the Rehabilitator or the Management Services Provider has determined, in their sole and absolute discretion, that (i) the payment obligation of the Segregated Account under the provisions of the underlying instrument or contract giving rise to such Claim or (ii) the underlying risk of loss insured pursuant to the provisions of the Policy or other Transaction Document(s) giving rise to such Claim is the subject of, or is, a Pending Claim, Disputed Claim, Late Claim, Disallowed Claim or a Permitted Claim.

Duplicate Claim means, in respect of a Musical Work, any Claim in which the Authorship or control of such Work or entitlement to a Share relating thereto is claimed by two or more persons, whether or not each Claimant is aware of the existence of the other’s Claim. It shall not include a Claim by a publisher that he has published a previously unpublished work unless the Author disputes the fact of such publication.
