Excess Proposals definition

Excess Proposals means if and to the extent they have been accepted by the Government as evidenced by the version of the Schedules as attached to the Articles of Agreement:1. any proposals in Schedule 11 (Excess Proposals); and/or2. any other proposals submitted by the Contractor exceeding the original requirements as set out in Part VII of the Tender Documents;then for evaluation under the Marking Scheme in Annex D to Part IIConditions of Tender and regardless of whether or not they also fulfil any of the desirable specifications. “GNC” means the Government New Construction Section, a unit within the Marine Department. “Government” means the Government of the Hong Kong Special Administrative Region of the People’s Republic of China. “Government Data” means all data, documents, information, text, drawings, diagrams, images or sound stored, presented or embodied in any electronic or tangible medium, and which are supplied or in respect of which access is granted to the Contractor by the Government for the purposes of or in relation to the Contract. “Government Dockyard” means the dockyard located at Ngong Shung Road, Stonecutters Island, Sham Shui Po, Kowloon, Hong Kong. “Government Representative” means the Director of Marine or any officer authorised to act on her behalf for the purposes of the Contract. “Guarantee Slipping” means for the Vessel, all work as specified in Paragraph 2 of Annex 1 to the Technical Specifications. “Hong Kong” or “HKSAR” means the Hong Kong Special Administrative Region of the People’s Republic of China. “HKPF” means the Hong Kong Police Force. “Hong Kong Waters” means all waters, whether navigable or not, included in the Hong Kong Special Administrative Region. “Implementation Timetable” or “Implementation Plan” means the time schedule and sequence of events for the performance of this Contract as specified in the Contract including the dates which are set out in Schedule 2 of Part V, and Annex 2 to the Technical Specifications and subject always to the foregoing, further elaborated and finalised by the Contractor and approved by the Government pursuant to the provisions of the Contract.

Examples of Excess Proposals in a sentence

  • Without prejudice to the need to state compliance as mentioned in Clause 5.3 above, the Tenderer may wish to submit Excess Proposals in relation to the Vessel or any of the Equipment which exceed the essential requirements and/or Specifications Without Label in Part VII.

  • Desirable Specifications in Part VII may or may not be specifications in relation to the Excess Proposals.

  • Innovative Suggestions are one type of Excess Proposals achieving any of the benefits specified in Part (A) of the Marking Scheme under the heading Innovative Suggestions.

  • If they are not specifications in relation to Excess Proposals as aforementioned, if and to the extent the Tenderer wishes to comply, the Tenderer shall indicate compliance with such Desirable Specifications in Schedule 11 of Part V under the heading “Desirable Specifications other than the specifications for the Excess Proposals”.

  • Even if the Tenderer is identified as the successful Tenderer for the award of the Contract pursuant to Clause 24.1 of this Part, the Government reserves the right to accept all or any part of the Tenderer’s offer including all or any of the Counter-Proposals and Excess Proposals.

  • Notwithstanding any of the statements of compliance in Schedule 5 in Part V, the Government will conduct checks at the tendering stage to determine whether the items offered by a Tenderer indeed comply with the Essential Requirements, viz., specifications labelled as [E] in the Technical Specifications, the Excess Proposals submitted by the Tenderer, and if evidence is readily available also compliance with the Specifications without Label.

  • Even if the Tenderer is identified as the successful Tenderer for the award of the Contract pursuant to Clause 24.1 of this Part, the Government reserves the right to accept all or any part of the Tenderer’s offer including all or any of the Excess Proposals.

  • For those specifications labelled as [D], they shall also form part of the Contract in the same aforesaid manner if and to the extent the Contractor has committed to comply with them during the tendering stage, whether or not as Excess Proposals as further mentioned below.

  • Without prejudice to the need to state compliance as mentioned in Clause 5.3 above, the Tenderer may wish to submit Excess Proposals in relation to the Vessel or any of the Equipment which exceed the Original Requirements.

  • For Excess Proposals for the Vessel and the Spare Parts exceeding the Original Requirements, the unit price quotations for the Vessel and the Spare Parts shall include and be deemed to have included such Excess Proposals.

Related to Excess Proposals

  • Proposal means the Technical Proposal and the Financial Proposal.

  • Proposals has the meaning specified in Section 8.02(c).

  • Alternative Proposal has the meaning set forth in Section 6.2(b).

  • Tax Proposals means all specific proposals to amend the Tax Act publicly announced by or on behalf of the Minister of Finance (Canada) prior to the date hereof.

  • Acquisition Proposal has the meaning set forth in Section 5.03(a).

  • Proposal / Bid means the technical proposal and the commercial/financial proposal.

  • Unsolicited proposal means a written proposal for a public-private initiative that is submitted by a private entity for the purpose of entering into an agreement with the department but that is not in response to a formal solicitation or request issued by the department.

  • Financial Proposal means the Contractor’s Financial Proposal dated (Financial Proposal date).

  • Superior Proposal has the meaning set forth in Section 5.09(a).

  • Takeover Proposal means any offer or proposal for, or any indication of interest in, a merger or other business combination involving Target or the acquisition of any significant equity interest in, or a significant portion of the assets of, Target, other than the transactions contemplated by this Agreement.

  • Competing Proposal means a proposal, offer or invitation to the Company, any Party or any of a Party’s Affiliates (other than the Proposal), that involves the acquisition of Control of the Target, a sale of all or a substantial part of the assets of the Target, a restructuring or recapitalization of the Target, or some other transaction that would adversely affect, prevent or materially reduce the likelihood of the consummation of the Transaction with the Parties.

  • Superior Proposal Notice has the meaning specified in Section 5.4(1)(c).

  • Request for Proposals or “RFP” means all documents, including those attached or incorporated by reference, used for soliciting proposals.

  • Technical Proposal means the Contractor’s Technical Proposal dated (Technical Proposal date).

  • TO Financial Proposal means the TO Contractor’s financial response to the CATS+ TORFP dated date of TO Financial Proposal.

  • Bid Proposal or “Proposal” means the bidder’s proposal submitted in response to the RFP.

  • Responsive Proposal means a Proposal that complies with the material provisions of this RFP.
