Examples of Existing Debentures in a sentence
If a holder of Existing Debentures has not provided written notice to the Corporation within thirty (30) Business Days of the receipt of a copy of any such agreement indicating such holder of Existing Debentures is electing to receive such rights or terms from such agreement, such Debentureholder shall be deemed to have elected not to receive such new rights or terms.
The Notes are unsecured and subordinate to current and future obligations and indebtedness of Cooperative, including the existing senior Note as listed in Appendix A: Existing Debentures of the Note.
The Amended Debentures shall have a principal amount equal to the principal amount of the Existing Debentures purchased by the Purchaser and shall be in substantially the form as the New Debenture.
Holder agrees that the Note shall be subordinate in rights of payment and priority to all current and future indebtedness to banks, commercial finance lenders, insurance companies, leasing and equipment financing institutions, and/or other institutions regularly engaged in the business of lending money, including the existing senior Note as listed in Appendix A: Existing Debentures.
To the extent that any of the Existing Debentures are purchased by the Purchaser prior to the Closing Date, the Existing Debentures purchased by the Purchaser shall be amended (the “Amended Debentures”), effective as of the Closing Date, to make its terms pari passu in all respects with the New Debenture.
