Extended Exclusivity Period definition

Extended Exclusivity Period means any period during which one of the following subsists in respect of a Product in a given country in the Territory: Orphan Drug Designation, paediatric designation or other exclusivity (excluding a Patent) granted by a Competent Authority beyond the expiry of the relevant Patent, which, in each case, confers exclusive marketing rights with respect to such Product in such country.

Extended Exclusivity Period means the later of: (a) any period during which one of the following subsists in respect of a Licensed Product in the relevant country: Orphan Drug Designation, paediatric designation or other exclusivity (excluding a Patent) granted by a Competent Authority beyond the expiry of the relevant Patent; or (b) the expiry of [***] ([***]) [***] from the date of the First Commercial Sale of that Licensed Product (or former Licensed Product) in the relevant country by Centry or a Sub-Licensee on an arm’s length terms.

Extended Exclusivity Period means with respect to a Licensed Product and/or any Additional Licensed Product in a country in the Territory, the period of time during which Nuvectis and/or any of its Affiliates and/or Sub-Licensees has been granted the exclusive legal right (excluding a Patent) by a Regulatory Authority in such country to sell the Licensed Product and/or any Additional Licensed Product, including through clinical trial data exclusivity, Orphan Drug Designation or paediatric designation, or other regulatory data exclusivity;

Examples of Extended Exclusivity Period in a sentence

• In order for Curis to exercise its right to obtain an Extended Exclusivity Period for a Program Target Profile, there must be, at the time when payment of the Extended Exclusivity Fee for such Extended Exclusivity Period is due, an Active Program for such Program Target Profile.

• Monopar shall pay royalties to Onxeo on a Licensed Product-by-Licensed Product and country-by-country basis until the later of (1) the date when the Licensed Product is no longer within the scope of a Valid Claim of a Licensed Patent in the country of sale or manufacture, (2) the expiry of any Extended Exclusivity Period in the relevant country, or [***] after the First Commercial Sale of the Licensed Product in such country.

• On a Program Target Profile-by-Program Target Profile basis, for each Extended Exclusivity Period by which Curis elects to extend the exclusivity of the Parties’ collaboration contemplated by Section 4.7(b) for a Program Target Profile beyond the Exclusivity Period, Curis shall pay to Aurigene no later than the applicable date specified in Section 4.8(b), a fee of $[**] per 12-month period for each applicable Program Target Profile (each, an “Extended Exclusivity Fee”).

• Subject to Sections 3.1(b)(ii), 3.8, 4.9 and 4.10 hereof, during the Exclusivity Period and each Extended Exclusivity Period, if any, for which Curis pays the Extended Exclusivity Fee, each Party agrees to work exclusively with the other Party in the manner contemplated under this Agreement on each Program Target Profile for which there is an Active Program (such Program Target Profile, an “Exclusive Program Target Profile”).

More Definitions of Extended Exclusivity Period

Extended Exclusivity Period shall have the meaning provided in Section 4.8(b).

Extended Exclusivity Period means, on a country-by-country and Licensed Product-by-Licensed Product basis, the later of:
