This Settlement Agreement is made and entered into by EPA and, the Department of Interior (DOI), through FWS (the Federal Trustee), and the State Trustees (collectively, EPA, the Federal Trustee, and the State Trustees are referred to as “Agencies”), and Big Hoss Properties, LLC (Settling Party).
In the event of irreconcilable disputes, the Trustees may agree to dissolve the Trustee Council and, if necessary, split funds into a state account to be controlled collectively by the Colorado Natural Resource Trustees and a federal account to be controlled by the Federal Trustee; however, disposition of funds recovered from potentially responsible parties (PRPs) will be governed by Section IX(A) below.
Settling Party shall make the payment to the Federal Trustee in accordance with the payment instructions attached as Appendix E.
Within 30 days after the Effective Date, Settling Party shall pay to the Federal Trustee $32,170.
This Agreement shall in no way prohibit or restrict either Federal Trustee from participating in similar activities with other public or private agencies, organizations, or individuals.
If any amount due to the Federal Trustee under Paragraph 18 is not paid by the required date, Settling Party shall be in violation of this Settlement Agreement and shall pay to the Federal Trustee, as a stipulated penalty, in addition to the Interest required by Paragraph 24 (Interest on Late Payments), $250 per violation per day that such payment is late.
