Fee and Cost Award definition

Fee and Cost Award means the amount of Attorneys’ Fees and Costs, if any, awarded by the Court to Class Counsel pursuant to a motion made under Section 10 herein, which will be paid out of the Settlement Amount.
Fee and Cost Award means such award of fees and actual litigation 23 costs/expenses as the Court may award to Class Counsel for the services they have rendered and 24 will render to Plaintiff, the Class, the LWDA, and the Aggrieved Employees in relation to 25 prosecuting the claims involved in this Action, which will be paid out of the Cash Payment 26 Amount and which is agreed by the Parties not to exceed twenty-five percent (25%) of the 27 Maximum Settlement Amount as the Fee Award, in addition to reasonable actual expenses, not 1 to exceed $35,000, as the Cost Award. Any portion of the Fee and Cost Award not awarded to 2 Class Counsel shall become part of the Net Cash Distribution.

Examples of Fee and Cost Award in a sentence

  • As part of the Motion for Final Approval, Class Counsel will move for approval of a Fee and Cost Award.

  • The Settlement Amount shall be applied as follows: to pay all Settlement Administration Costs; to pay any other Court-approved fees and expenses; to distribute the Net Settlement Fund to Settlement Class Members; to pay the Fee and Cost Award; and to pay the Service Award.

  • Performance Bonus means the performance bonus in respect of each Class payable to the General Partner by the Partnership which will be equal to 20% of the product of: (a) the number of Units of that Class outstanding on the Performance Bonus Date; and (b) the amount by which the Net Asset Value per Unit of that Class on the Performance Bonus Date (prior to giving effect to the Performance Bonus) plus the aggregate value of all distributions per Unit of that Class during the Performance Bonus Term exceeds $25.00.

  • Fee Award means the amount of attorneys’ fees and reimbursement of expenses awarded by the Court to Class Counsel, which will be paid out of the Settlement Fund.

  • Direct Award Criteria means the award criteria to be applied for the award of Call-Off Contracts for Standard Services set out in Part 1 of Schedule 6 (Award Criteria) of this Framework Agreement;

  • Performance Assurance means collateral in the form of cash or letters of credit, or other security acceptable to the requesting Party.

  • Performance Award means any right granted under Section 6(d) of the Plan.

  • System for Award Management (SAM means the primary Government repository for prospective Federal awardee and Federal awardee information and the centralized Government system for certain contracting, grants, and other assistance-related processes. It includes—

  • energy performance contracting means a contractual arrangement between the beneficiary and the provider of an energy efficiency improvement measure, verified and monitored during the whole term of the contract, where investments (work, supply or service) in that measure are paid for in relation to a contractually agreed level of energy efficiency improvement or other agreed energy performance criterion, such as financial savings;

  • Performance Cash Award means an award of cash granted pursuant to the terms and conditions of Section 6(c)(ii).
