Final Condition Survey definition

Final Condition Survey means a survey of the composition and condition of the Reaction Ferry, the Ferry Facility and Equipment on the Site to be carried out as determined by the Province within thirty days prior to the termination of this Agreement.
Final Condition Survey means the inspection and review by the City and the Operator of the Pelletizer Facility in accordance with a protocol to be prepared and provided by the Operator in accordance with Article 5.8 of this Agreement and approved by the City, acting reasonably.
Final Condition Survey means the inspection and review by the City and the Operator of the Pelletizer Facility in accordance with a protocol to be prepared and provided by the Operator in accordance with Article 5.9 of this Agreement and approved by the City, acting reasonably.

Examples of Final Condition Survey in a sentence

  • The Operator shall submit the Final Condition Survey report to the City at least ten (10) months before the expiry of the Term of this Agreement.

  • The Contractor shall arrange, at its cost, for both an Initial Condition Survey and a Final Condition Survey to be carried out by a qualified surveyor as approved by the Province.

  • Based on the results of the Final Condition Survey, the Operator shall prepare and submit to the Utility for the approval of the Utility, a remediation plan to correct any remaining deficiencies, excluding normal wear and tear, in the Facilities.

  • In addition to and without prejudice to the other rights of the City upon the Reversion Date, the Operator covenants that the Pelletizer Facility shall be in the Required Condition on the Reversion Date and shall not contain any Deficiencies including any Deficiencies identified in the Final Condition Survey pursuant to Article 5.9.

  • As a part of the Final Condition Survey, the City may request, at its cost, that the Operator retain an independent third party acceptable to the City to drain all tanks chambers or vessels that cannot normally be inspected at the Pelletizer Facility to conduct an inspection of the aforementioned structures provided such actions do not interfere with the Operator’s production schedule or its ability to meet its other obligations in this Agreement.

  • In addition to and without prejudice to the other rights of the City upon the Reversion Date, the Operator covenants that the Pelletizer Facility shall be in the Required Condition on the Reversion Date and shall not contain any Deficiencies including any Deficiencies identified in the Final Condition Survey pursuant to Article 5.8.

  • Without limiting the generality of the foregoing, the Final Condition Survey shall identify any element or part of the Pelletizer Facility that is not in the Required Condition.

  • Twelve (12) months before the expiry of the Term of this Agreement, the City and the Operator shall conduct a detailed inspection of the Pelletizer Facility, and the Operator shall prepare a Final Condition Survey of the Pelletizer Facility.

  • Also disclose that as a result of this election, the financial statements may not be comparable to companies that comply with public company effective dates with similar disclosure.

  • In the event the Final Condition Survey determines that any or all of the Reaction and Aerial Ferry, Docks, Ramps, Moveable Ramps, associated components, the Ferry Facility and the Equipment is not in the same or better condition than it was at the time of the Initial Condition Survey, then repairs and replacement shall be completed and the Contractor shall bear the cost of the same.

Related to Final Condition Survey

  • Special Condition means a condition of a Transporter's Licence or Shipper's Licence other than a Standard Condition;

  • Terminal condition means an incurable condition caused by injury, disease, or illness that according to reasonable medical judgment will produce death within six months, even with available life-sustaining treatment provided in accordance with the prevailing standard of medical care.

  • Special Conditions means Special Conditions of Contract, which override the General Conditions, also referred to as SCC.

  • Abnormal Condition means any condition on the Interconnection Facilities which, determined in accordance with Good Utility Practice, is: (i) outside normal operating parameters such that facilities are operating outside their normal ratings or that reasonable operating limits have been exceeded; and (ii) could reasonably be expected to materially and adversely affect the safe and reliable operation of the Interconnection Facilities; but which, in any case, could reasonably be expected to result in an Emergency Condition. Any condition or situation that results from lack of sufficient generating capacity to meet load requirements or that results solely from economic conditions shall not, standing alone, constitute an Abnormal Condition.

  • Environmental Condition means any condition or circumstance, including the presence of Hazardous Substances which does or would (i) require assessment, investigation, abatement, correction, removal or remediation under any Environmental Law, (ii) give rise to any civil or criminal Liability under any Environmental Law, (iii) create or constitute a public or private nuisance or (iv) constitute a violation of or non-compliance with any Environmental Law.

  • Additional Conditions means the terms and conditions set out in the Offer Document.

  • Environmental Conditions means the presence in the environment, including the soil, groundwater, surface water or ambient air, of any Hazardous Material at a level which exceeds any applicable standard or threshold under any Environmental Law or otherwise requires investigation or remediation (including, without limitation, investigation, study, health or risk assessment, monitoring, removal, treatment or transport) under any applicable Environmental Laws.

  • General Condition means these General Terms and Conditions of Contract.

  • Property Condition Report means a report prepared by a company satisfactory to Lender regarding the physical condition of the Property, satisfactory in form and substance to Lender in its sole discretion.

  • Due Diligence Examination shall have the meaning set forth in Section 3.2.

  • Existing Survey means the existing ALTA survey of the Property.

  • Physical Conditions Report means, with respect to the Property, a report prepared by a company satisfactory to Lender regarding the physical condition of the Property, satisfactory in form and substance to Lender in its sole discretion, which report shall, among other things, (a) confirm that the Property and its use complies, in all material respects, with all applicable Legal Requirements (including, without limitation, zoning, subdivision and building laws) and (b) include a copy of a final certificate of occupancy with respect to all Improvements on the Property.

  • Contracting Body Satisfaction Survey shall have the meaning set out in Clause 18.1;

  • Adverse Environmental Condition means (i) the existence or the continuation of the existence, of an Environmental Contamination (including, without limitation, a sudden or non-sudden accidental or non-accidental Environmental Contamination), of, or exposure to, any substance, chemical, material, pollutant, Hazardous Substance, odor or audible noise or other release or emission in, into or onto the environment (including without limitation, the air, ground, water or any surface) at, in, by, from or related to any Equipment, (ii) the environmental aspect of the transportation, storage, treatment or disposal of materials in connection with the operation of any Equipment, or (iii) the violation, or alleged violation, of any Environmental Law, permits or licenses of, by or from any governmental authority, agency or court relating to environmental matters connected with any of the Equipment.

  • Medical condition means either of the following:

  • Phase I assessment as described in, and meeting the criteria of, (i) Chapter 5 of the FNMA Multifamily Guide or any successor provisions covering the same subject matter in the case of a Specially Serviced Mortgage Loan as to which the related Mortgaged Property is multifamily property or (ii) the American Society for Testing and Materials in the case of Specially Serviced Mortgage Loan as to which the related Mortgaged Property is not multifamily property.

  • Title Report has the meaning set forth in Section 5.4(b).

  • Survey means a survey of the Property prepared by a surveyor licensed in the State and satisfactory to Lender and the company or companies issuing the Title Insurance Policy, and containing a certification of such surveyor satisfactory to Lender.

  • Condition Report means a condition report with respect to a Group III Vehicle, signed and dated by a Lessee or a Franchisee and any Manufacturer or its agent in accordance with the applicable Vehicle Disposition Program.

  • Final Completion means the date determined and certified by A/E and Owner on which the Work is fully and satisfactorily complete in accordance with the Contract.

  • Phase I Environmental Report means a report by an Independent Person who regularly conducts environmental site assessments in accordance with then current standards imposed by institutional commercial mortgage lenders and who has a reasonable amount of experience conducting such assessments.

  • Environmental and Social Impact Assessment or “ESIA” means a site-specific report, to be prepared in accordance with the parameters laid down in the ESMF (as hereinafter defined) and acceptable to the Association, identifying and assessing the potential environmental and social impacts of the activities to be undertaken for the Project, evaluating alternatives, and designing appropriate mitigation, management, and monitoring measures.

  • Environmental Impact Assessment means a systematic examination conducted to determine whether or not a programme, activity or project will have any adverse impacts on the environment;

  • Congenital Condition(s) means (a) any medical, physical or mental abnormalities existed at the time of or before birth, whether or not being manifested, diagnosed or known at birth; or (b) any neo-natal abnormalities developed within six (6) months of birth.

  • Environmental Report The environmental audit report or reports with respect to each Mortgaged Property delivered to the related Mortgage Loan Seller in connection with the origination or acquisition of the related Mortgage Loan.

  • Supplemental Conditions means those terms and conditions, if included in the Agreement by mutual written agreement of the Parties, which add to or modify the Agreement and are incorporated by reference as if fully set forth in the Agreement. In the case of a conflict between the Supplemental Conditions and the Agreement, the Supplemental Conditions shall prevail.
