Generation Contingent definition

Generation Contingent means Seller’s failure to Deliver is excused if the Renewable Energy Facility for any reason does not generate sufficient measured energy in the Vintage or other time period indicated to satisfy all obligations of RECs delivery assigned by Seller to the Renewable Energy Facility. In such event, Seller shall not be liable to Buyer for any damages, including any amounts determined pursuant to Article 5.
Generation Contingent means that Seller’s failure to deliver is excused if the Distributed Generation Resources for any reason do not generate sufficient energy necessary to deliver Net Energy Billing Credits hereunder. In such an event, Seller shall not be liable to Buyer for any damages.
Generation Contingent means that each Seller’s failure to deliver is excused if the Distributed Generation Resources for any reason do not generate sufficient energy necessary to deliver Bill Credits hereunder. In such an event, Sellers shall not be liable to Buyer for any damages.

In such event, Seller shall not be liable to Buyer for any damages, including any amounts determined pursuant to Article 5.

  • Renewable energy facility means an electric generation unit or other facility or installation that produces electric energy using a Renewable Energy Source.

  • Eligible Renewable Energy Resource or “ERR” has the meaning set forth in California Public Utilities Code Section 399.12 and California Public Resources Code Section 25741, as either code provision is amended or supplemented from time to time.

  • Guaranteed Commercial Operation Date has the meaning set forth in Section 3.9(c)(i).

  • Guaranteed Energy Production or “GEP” has the meaning set forth in Section 3.1(e)(ii).

  • Energy Use Intensity (EUI means the kBTUs (1,000 British Thermal Units) used per square foot of gross floor area.
