Guaranteed Project Substantial Completion Date means [insert date].
Guaranteed Project Substantial Completion Date means October 31, 2019, as modified in accordance with Section 5.5 and Article 9; provided, that (a) if the Closing Date occurs after November 1, 2018 and on or prior to March 1, 2019, the Guaranteed Project Substantial Completion Date shall be extended on a day for day basis for each day between November 2, 2018 and the Closing Date, (b) if the Closing Date occurs on or after March 2, 2019 and on or before June 30, 2019, the Guaranteed Project Substantial Completion Date shall mean August 31, 2020, and (c) if, following issuance by Owner of a Limited Notice to Proceed on or before July 1, 2019, the Closing Date occurs on or before September 1, 2019, the Guaranteed Project Substantial Completion Date shall mean October 31, 2020, in each case as modified in accordance with Section 5.5 and Article 9.

Examples of Guaranteed Project Substantial Completion Date in a sentence

  • Except as set forth in Section 6.2, Section 9.2 or Section 3.4 of this Agreement or unless otherwise expressly provided by the terms of this Agreement, there shall be no increase in the Contract Price or extension in the Guaranteed Project Substantial Completion Date except as agreed in writing by the Parties or otherwise expressly provided by this Agreement.

  • The proposed recovery schedule will, at a minimum, demonstrate the means by which Seller intends to recapture lost time, meet Critical Milestones and achieve Project Substantial Completion by the Guaranteed Project Substantial Completion Date.

  • Seller agrees that if Project Substantial Completion is not achieved by the Guaranteed Project Substantial Completion Date, then Seller shall pay the Daily Delay Liquidated Damages to Purchaser for each Day that Seller fails to achieve Project Substantial Completion after the Guaranteed Project Substantial Completion Date until Project Substantial Completion is achieved (the “Delay Liquidated Damages”).

  • After Seller’s compliance with Section 10.2, the Parties shall execute a Change Order to (a) adjust the Critical Path Project Schedule (other than the Guaranteed Project Substantial Completion Date), to account for material delays to the Critical Path Project Schedule resulting from the Excusable Event and/or (b) adjust the Contract Price to account for the material increase in the cost of the performance of the Work resulting from the Excusable Event.

  • After achieving Project Substantial Completion, Seller may, at its option and sole cost and expense, continue to attempt to achieve the Minimum Guaranteed Plant Reliability until the date that is ninety (90) Days after the Guaranteed Project Substantial Completion Date (such period, the “Reliability Test Cure Period”).

  • After achieving Project Substantial Completion, Seller may, at its option and sole cost and expense, continue to attempt to achieve the Minimum Guaranteed Plant Capacity until the date that is ninety (90) Days after the Guaranteed Project Substantial Completion Date (such period, the “Capacity Test Cure Period”).

  • After achieving Project Substantial Completion, Seller may, at its option and sole cost and expense, continue to attempt to achieve the Guaranteed XXXX XX Efficiency until the date that is ninety (90) Days after the Guaranteed Project Substantial Completion Date (such period, the “XXXX XX Efficiency Test Cure Period”).

  • After achieving Project Substantial Completion, Seller may, at its option and sole cost and expense, continue to attempt to achieve the Guaranteed PV Plant Capacity and Guaranteed XXXX Storage Capacity until the date that is ninety (90) Days after the Guaranteed Project Substantial Completion Date (such period, the “Capacity Test Cure Period”).

  • After achieving Project Substantial Completion, Seller may, at its option and sole cost and expense, continue to attempt to achieve the Guaranteed PV Plant Capacity until the date that is ninety (90) Days after the Guaranteed Project Substantial Completion Date (such period, the “Capacity Test Cure Period”).

  • Developer shall cause Project Substantial Completion to occur on or before the Guaranteed Project Substantial Completion Date.

Related to Guaranteed Project Substantial Completion Date

  • Guaranteed Substantial Completion Date or “Guaranteed Substantial Completion Dates” has the meaning set forth in Section 5.3B.

  • Substantial Completion Date means the date on which Substantial Completion occurs.

  • Project Completion Date means the date on which the Completion Certificate is issued;

  • Substantial Completion means the stage in the progress of the work as determined and certified by the Contracting Officer in writing to the Contractor, on which the work (or a portion designated by the Government) is sufficiently complete and satisfactory. Substantial completion means that the property may be occupied or used for the purpose for which it is intended, and only minor items such as touch-up, adjustments, and minor replacements or installations remain to be completed or corrected which:

  • project completion period means the period of sixty (60) months commencing from and expiring on for the construction and obtaining of Temporary Occupation Permit or Permits for the whole of the Development as provided in clause 3.3;

  • Construction Completion Date means the Completion Date of the Construction as specified in the Statutory Declaration of Completion for the Project;

  • Completion Date means the date of completion of the Services by the Service Provider as certified by the Procuring Entity

  • Final Completion Date means the date on which Final Completion occurs.

  • Project Completion means the date, as determined by the Division after consultation with the Recipient, that operation of the Project is initiated or is capable of being initiated, whichever comes first.

  • Substantial Completion Certificate means the certificate issued and approved by the Authority indicating the date upon which the Trade Contractor Work (or a designated portion thereof) is Substantially Complete.

  • Capital Improvement Project means the acquisition, construction, reconstruction, improvement, planning and equipping of roads and bridges, appurtenances to roads and bridges to enhance the safety of animal-drawn vehicles, pedestrians, and bicycles, wastewater treatment facilities, water supply systems, solid waste disposal facilities, and storm water and sanitary collection, storage and treatment facilities including real property, interests in real property, facilities, and equipment related or incidental to those facilities.

  • Target Completion Date has the meaning given such term in Section 3.3(b).

  • Completion Period means the period starting from the date of issue of "Order" and required to complete the work in all respect.

  • Certificate of Substantial Completion means the certificate executed by the A/E, ODR and Contractor that documents to the best of A/E’s and ODR’s knowledge and understanding, Contractor’s sufficient completion of the work in accordance with the Contract, so as to be operational and fit for the use intended.

  • Final Completion means the date determined and certified by A/E and Owner on which the Work is fully and satisfactorily complete in accordance with the Contract.

  • Subproject means a specific project to be carried out by an existing BE utilizing the proceeds of a Sub-loan or Investment, as hereinafter defined, fulfilling the conditions set forth in Part A of Schedule 4 to this Agreement;

  • The Completion Date means the date of completion of the Works as certified by the Employer’s Representative.

  • Landlord’s Work means the work of constructing the Tenant Improvements.

  • Tenant Improvement Work means the construction of the Tenant Improvements, together with any related work (including demolition) that is necessary to construct the Tenant Improvements.

  • Landlord Work means the work, if any, that Landlord is obligated to perform in the Premises pursuant to a separate agreement (the “Work Letter”), if any, attached to this Lease as Exhibit C.

  • Construction Completion Certificate means a certificate of the I-Bank to the effect that the construction of the Project is complete.

  • Guaranteed Construction Start Date means the Expected Construction Start Date, as such date may be extended by the Development Cure Period.

  • Project Commencement Date means the commencement date notified to the Minister pursuant to clause 4(1);

  • Construction Completion means physical construction of a cleanup action component is complete.

  • Project Completion Schedule means the progressive Project Milestones set forth in Schedule-J for completion of the Project Highway on or before the Scheduled Completion Date;

  • Pilot project means an innovative environmental project that covers one or more designated facilities, designed and implemented in the form of an EMSA. (See Section 52.3 of the Act.)
