Health Care Requirements definition

Health Care Requirements means, with respect to each Facility, all federal, state, county, municipal and other governmental statutes, laws, rules, orders, regulations, ordinances, judgments, decrees and injunctions or agreements, in each case, pertaining to the ownership, operation, use or occupancy of such Facility or any portion thereof in accordance with its applicable Health Care Licenses and Government Payor Program participation.

Health Care Requirements means, relating to the Leased Premises, all federal, state, county, municipal and other governmental statutes, laws, rules, orders, regulations, ordinances, judgments, decrees and injunctions or agreements, in each case, pertaining to or concerned with the establishment, construction, ownership, operation, use or occupancy of the Leased Premises or any part thereof as a health care facility, and all material permits, licenses and authorizations and regulations relating thereto, including all material rules, orders, regulations and decrees of and agreements with health care authorities pertaining to the Leased Premises.

Health Care Requirements means, relating to the Land, all federal, state, county, municipal and other governmental statutes, laws, rules, orders, regulations, ordinances, judgments, decrees and injunctions or agreements, in each case, pertaining to or concerned with the establishment, construction, ownership, operation, use or occupancy of the Land or any part thereof as a skilled nursing facility, and all material permits, licenses and authorizations and regulations relating thereto, including all material rules, orders, regulations and decrees of and agreements with health care authorities pertaining to the Land.

• Subject to the rights of Tenants and subtenants and in accordance with applicable Legal Requirements and Health Care Requirements, Borrower shall permit (or cause Mortgage Borrower to permit) agents, representatives and employees of Lender to inspect each Individual Property or any part thereof at reasonable hours upon reasonable advance notice.

• All material state, county and municipal recording, stamp, intangible or other similar tax required to be paid by any Person under applicable Legal Requirements and applicable Health Care Requirements currently in effect in connection with the execution, delivery, recordation, filing, registration, perfection or enforcement of any of the Loan Documents, including the Pledge Agreement, have been paid or will be paid at Closing.

• Subject to the rights of Tenants and subtenants and in accordance with applicable Legal Requirements and Health Care Requirements, Borrower shall permit agents, representatives and employees of Lender to inspect each Individual Property or any part thereof at reasonable hours upon reasonable advance notice.

• With respect to the RIDEA Facilities, which are not subject to a Restricted Account due to Health Care Requirements, Borrower shall deposit, or cause to be deposited, all revenue generated by the RIDEA Facilities and due and payable to Borrower into the applicable RIDEA Account.

Health Care Requirements means all Laws, Orders or agreements, in each case regulating the establishment, construction, ownership, operation, use or occupancy of the SCAN Business or the CareOregon Business, as applicable, and all Permits relating thereto, including all rules, orders, regulations and decrees of and agreements with Regulatory Authorities as pertaining to the SCAN Business or the CareOregon Business, as applicable.

Health Care Requirements means, with respect to each Individual Property, all federal, state, county, municipal and other governmental statutes, laws, rules, orders, regulations, ordinances, standards, policies, judgments, decrees and injunctions or agreements, in each case regulating the establishment, construction, ownership, operation, use or occupancy of such Individual Property or any part thereof as a skilled nursing facility or assisted living facility, and all material permits, licenses and authorizations and regulations relating thereto, including all material rules, orders, regulations and decrees of and agreements with Health Care Authorities as pertaining to such Individual Property.

Health Care Requirements means, with respect to the Facility, all applicable laws, Laws, judgments, guidance, guidelines, requirements and contracts, in each case, pertaining to or concerned with the establishment, construction, ownership, operation, use or occupancy of the Facility or any part thereof as a RCFE or other health care facility and all Licenses and Permits, or any of the foregoing promulgated by any Health Care Authority and including all applicable laws and Laws promulgated by judgments of and contracts with Health Care Authorities as pertaining to the Facility.

Health Care Requirements means, relating to the Leased PremisesHealthcare Facility, all federal, state, county, municipal and other governmental statutes, laws, rules, orders, regulations, ordinances, judgments, decrees and injunctions or agreements, in each case, pertaining to or concerned with the establishment, construction, ownership, operation, use or occupancy of the Leased PremisesHealthcare Facility or any part thereof as a health care facility, and all material permits, licenses and authorizations and regulations relating thereto, including all material rules, orders, regulations and decrees of and agreements with health care authorities pertaining to the Leased PremisesHealthcare Facility.

Health Care Requirements means, with respect to the Facility, all applicable laws, judgments and contracts, in each case, pertaining to or concerned with the establishment, construction, ownership, operation, use or occupancy of the Facility or any part thereof as a nursing facility, long-term acute care facility, assisted living facility or other health care facility and all licenses and permits, including all applicable laws promulgated by judgments of and contracts with Health Care Authorities as pertaining to the Facility.

Health Care Requirements means, with respect to each Project, all federal, state, county, municipal and other governmental statutes, laws, rules, orders, regulations, ordinances, standards, policies, judgments, decrees and injunctions or agreements, in each case regulating the establishment, construction, ownership, operation, use or occupancy of such Project or any part thereof for its Primary Intended Use and all material permits, licenses and authorizations and regulations relating thereto, including all material rules, orders, regulations and decrees of and agreements with Governmental Authorities as pertaining to such Project.
