Hedge Instrument definition

Hedge Instrument means any interest rate cap agreement, interest rate floor agreement, interest rate swap agreement or other interest rate hedging agreement entered into by Seller with a counterparty reasonably acceptable to Agent, in each case with respect to the Mortgage Loans.
Hedge Instrument means, with respect to any Person, any interest rate, foreign exchange or commodity price risk management agreement or product, including interest rate, currency or commodity exchange or swap agreements, futures contracts, forward rate agreements, interest rate cap agreements and interest rate collar agreements, options and all other agreements or arrangements designed primarily to protect such Person against fluctuations in interest rates, currency exchange rates or commodity prices.
Hedge Instrument means any interest rate cap agreement, interest rate floor agreement, interest rate swap agreement or other interest rate hedging agreement entered into by Seller with a Hedge Counterparty. Each Hedge Instrument shall meet the requirements set forth in Section 38 hereof with respect thereto and shall be a hedging instrument as described in Section 856(c)(6) of the Code.

Examples of Hedge Instrument in a sentence

  • Any Person becoming a Holder of Secured Hedge Obligations from time to time in accordance with such Secured Hedge Instrument shall be and become a Holder of Secured Hedge Obligations for the purposes of this Agreement and each Person ceasing to be a Holder of Secured Hedge Obligations from time to time in accordance with such Secured Hedge Instrument shall cease to be a Holder of Secured Hedge Obligations for the purposes of this Agreement.

  • Assignments of Secured Debt, Secured Hedge Obligations or Secured Gas Hedge Obligations shall be in accordance with and subject to the provisions of the applicable Secured Debt Instrument, Secured Hedge Instrument or Secured Gas Hedge Instrument.

More Definitions of Hedge Instrument

Hedge Instrument means (a) any currency swap agreement, option contract, future contract, option on futures contract, spot or forward contract, or other agreements to purchase or sell currency or any other arrangement entered into by a Person to hedge such Person’s exposure or to speculate on movements in rates of exchange of currencies; (b) any interest rate swap, option contract, futures contract, options on futures contract, cap, floor, collar, or any other similar hedging arrangements entered into by a Person to hedge such Person’s exposure to or to speculate on movements in interest rates; (c) Commodity Hedge Instrument; and (d) any other derivative transaction or hedging arrangement of any type or nature whatsoever that is the subject at any time of trading in the over-the-counter derivatives market.
Hedge Instrument means any swap, cap or collar agreement, forward sale contract, option contract, futures contract, interest-only security, principal-only security or similar arrangement providing for protection against fluctuations in interest rates or the exchange of nominal interest obligations or declines in market value, either generally or under specific contingencies, entered into by a Seller with a Hedge Counterparty and reasonably acceptable to Buyer.

Hedge Instrument means (a) currency swap agreements, option contracts, futures contracts, options on futures contracts, spot or forward contracts or other agreements to purchase or sell currency or any other arrangement entered into by a Person to hedge such Person’s exposure or to speculate on movements in the rates of exchange of currencies, (b) interest rate swaps, option contracts, futures contracts, options on futures contracts, cap, floors, collars or any other similar hedging arrangements entered into by a Person to hedge such Person’s exposure to or to speculate on movements in interest rates, (c) forward purchases and sales, put options, synthetic put options, call options, collars or any other arrangement relating to commodities entered into by a Person to hedge such Person’s exposure to or to speculate on commodity prices, and (d) any other derivative transaction or hedging arrangements of any type or nature whatsoever that is the subject at any time of trading in the over-the-counter derivatives market. “Hedge Instruments” shall exclude, to the extent included, the Borrower Concentrate Sales Agreement.
Hedge Instrument means any interest rate cap agreement, interest rate floor agreement, interest rate swap agreement or other interest rate hedging agreement entered into by a Seller or the Guarantor with a counterparty approved by the Buyer to hedge such Seller’s interest rate risk with respect to the mortgage loans in such Seller’s portfolio (which includes Mortgage Loans sold hereunder). The Sellers shall provide a monthly report to the Buyer which sets forth any such Hedge Instrument entered into by the Sellers and shall provide the Buyer with all information relating to such Hedge Instrument that the Buyer may reasonably request.
Hedge Instrument means any interest rate cap agreement, interest rate floor agreement, interest rate swap agreement or other interest rate hedging agreement entered into by Seller with a counterparty reasonably acceptable to Agent, in each case with respect to the Mortgage Loans. “High Cost Mortgage Loan” means a Mortgage Loan that is (a) subject to, covered by or in violation of the provisions of the Homeownership and Equity Protection Act of 1994, as amended, (b) a “high cost,” “covered,” “threshold,” “abusive,” “predatory” or “high risk” mortgage loan under any federal, state or local law, or any similarly classified loan using different terminology under any law imposing heightened regulation, scrutiny or additional legal liability for residential mortgage loans having high interest rates, points and/or fees, or any other state or other regulation providing assignee liability to holders of such mortgage loans, (c) subject to or in violation of any such or comparable federal, state or local statutes or regulations, or (d) a “High Cost Loan” or “Covered Loan,” as applicable, as such terms are defined in the current version of the Standard & Poor’s LEVELS® Glossary Revised, Appendix E. 2126 The definition ofXxxxxx Xxx Security” was amended by Amendment No. 1, dated as of September 24, 2021. 2227 The definition of “Xxxxx Investors” was added by Amendment No. 1, dated as of September 24, 2021.
