Initial Indenture definition

Initial Indenture. The indenture dated as of July 12, 2010, by and among MergerCo and Well Fargo Bank, National Association, as trustee (“Trustee”) pursuant to which the Initial Notes were issued and the Exchange Securities are to be issued as such Indenture may be further amended or supplemented from time to time in accordance with the terms thereof.
Initial Indenture means the trust indenture dated July 22, 2005 between the Fund, and the Debenture Trustee, governing the terms of the Debentures;
Initial Indenture means that certain indenture, dated as of August 2, 2018 (as amended, restated, supplemented or otherwise modified, Refinanced or replaced from time to time), among the Company, the Co-Issuer, the guarantors identified therein, and Wilmington Trust, National Association, as trustee and collateral agent, with respect to the 9.00% Senior Second Lien Notes due 2025 of the Company and the Co-Issuer.

Examples of Initial Indenture in a sentence

  • Except as expressly modified or amended hereby with respect to the Notes, the Initial Indenture continues in full force and effect and is in all respects confirmed and preserved.

  • The following covenants shall apply to the Notes (but not with respect to any other series of Debt Securities), and are in addition to the covenants set forth in Article Four of the Initial Indenture.

  • With respect to the Notes (but not with respect to any other series of Debt Securities), to the extent inconsistent with the covenants contained in Article Four of the Initial Indenture the covenants set forth in this Supplemental Indenture shall govern.

  • To the extent terms defined herein differ from the Initial Indenture the terms defined herein will govern.

  • The following provisions of this Article Eight shall apply to the Notes (but not with respect to any other series of Debt Securities) and shall replace in their entirety Sections 12.1 and 12.2 of the Initial Indenture.


More Definitions of Initial Indenture

Initial Indenture has the meaning set forth in the first paragraph of this Agreement.
Initial Indenture the Indenture governing the Senior Notes, as the same may be amended, restated, amended and restated, refinanced, replaced, extended, modified or further supplemented from time to time in accordance with the terms of this Agreement.
Initial Indenture means the Indenture between the Company and The Chase Manhattan Bank, as trustee, dated as of February 16, 2000, relating to up to $172,500,000 aggregate principal amount of the Company's 7% Convertible Subordinated Notes due 2005 certificated and delivered pursuant thereto (as it may from time to time be supplemented or amended pursuant to the applicable provisions thereof).
Initial Indenture means any of (a) the Trust Indenture and Security ----------------- Agreement (GARC II 98-A), dated as of September 1, 1998, between the Initial Owner Trustee (GARC II 98-A) and the Initial Indenture Trustee (GARC II 98-A), (b) the Trust Indenture and Security Agreement (GARC II 98-B), dated as of September 1, 1998, between the Initial Owner Trustee (GARC II 98-B) and the Initial Indenture Trustee (GARC II 98-B) and (c) the Trust Indenture and Security Agreement (GARC II 98-C), dated as of September 1, 1998, between the Initial Owner Trustee (GARC II 98-C) and the Initial Indenture Trustee (GARC II 98-C).
Initial Indenture has the meaning provided in the preamble to this Indenture.
Initial Indenture means any of (a) the Trust Indenture and Security ----------------- Agreement (1998-1), dated as of August 1, 1998, between the Initial Owner Trustee (1998-1) and the Initial Indenture Trustee (1998-1), [(b) the Trust Indenture and Security Agreement (1998-2), dated as of August 1, 1998, between the Initial Owner Trustee (1998-2) and the Initial Indenture Trustee (1998-2) and (c) the Trust Indenture and Security Agreement (1998-3), dated as of August 1, 1998, between the Initial Owner Trustee (1998-3) and the Initial Indenture Trustee (1998-3)].
