Latent Conditions definition

Latent Conditions means physical conditions on the Site or its surrounds including artificial things and the conditions in which the Supply must be carried out, including subsurface conditions and the condition, dimensions and performance of plant and equipment, but excluding weather, which differ from those conditions expressly described, assumed or allowed for in the Contract, or from those conditions which a competent contractor should reasonably have anticipated if it had visually inspected the Site and reviewed the written information provided by You.
Latent Conditions means any unforeseen site condition not obvious to us upon a reasonable inspection of the site at the time of the quotation, work authorisation, tender or other form.
Latent Conditions mean any and all physical inground conditions at the Site or its surroundings, including, without limitation, contamination and other environmental issues, heritage issues, artificial things, archaeology and the presence of fauna or flora or services which differ materially from the physical conditions which should reasonably have been anticipated by a competent contractor at the date of the Contract if the contractor had— examined all information made available in writing by the Principal to the Contractor for the purpose of the WUC; examined all information relevant to the risks, contingencies and other circumstances having an effect on the WUC and obtainable by the making of reasonable enquiries; and inspected the Site and its surroundings and carried out geotechnical investigations at the Site.
