Leased Spectrum definition

Leased Spectrum means the spectrum which is leased by a Sprint Subsidiary from a third party and which Operator is entitled to use pursuant to the terms of this Agreement, including, (a) subject to the terms of Section 3.2(b), all spectrum listed in Schedule R-2 which is attributable to a Closed Market and (b) any ITFS or MDS spectrum which is hereafter leased to a Sprint Subsidiary, or which a Sprint Subsidiary is otherwise entitled to use in the Markets, pursuant to any contractual arrangement, and which is leased to Operator pursuant to the terms of Section 5.5 of this Agreement. Upon any Market becoming a Closed Market, subject to Section 3.2(b), any spectrum listed in Schedule R-2 attributable to such newly Closed Market will automatically be considered as Leased Spectrum for purposes of this Agreement.
Leased Spectrum means solely the spectrum authorized pursuant to the Leased Authorizations, irrespective of the Initial Closing Date or any Market Closing Date. SPRINT PROPRIETARY INFORMATION EXECUTION VERSION

Examples of Leased Spectrum in a sentence

  • Customer may transmit or receive over the Leased Spectrum only in the Service Territory and only using FlexNet equipment manufactured by Sensus and used in accordance with Sensus’ specifications.

  • Customer may use the Leased Spectrum only to read and direct meters in support of Customer’s primary utility business or any other operation approved by Sensus in writing.

  • Without limiting the foregoing, Customer is prohibited from reselling, subleasing or sublicensing the Leased Spectrum or from transmitting voice communications over the Leased Spectrum.

  • Customer shall pay the Ongoing Fees for use of the Leased Spectrum.

  • Lessee acknowledges that Lessee shall remain independently responsible to Lessor and the FCC for complying with the foregoing, and agrees that it shall not construct or operate any facility utilizing the Leased Spectrum in a manner inconsistent with, contrary to, or in violation of, these requirements.

  • Lessee hereby represents and warrants that it is familiar with the Communications Laws and further covenants, warrants and agrees that it shall operate on and utilize the Leased Spectrum at all times in compliance in all material respects with the Communications Laws applicable to the Leased Spectrum.

  • In order to facilitate the transition of the operation of the Spectrum from Sprint to Operator, including performance of functions traditionally associated with the maintenance of the Leased Spectrum (as defined in the Market Operation Agreement), the parties desire to enter into this Agreement.

  • Sprint agrees to provide Additional Services which are necessary to maintain the Primary Leases, Leased Spectrum and Sprint Authorizations, as reasonably requested by Operator during the Term.

  • Operator will enforce and require strict performance of all material terms of each Primary Lease; provided, however, that upon the direction of the relevant Sprint Subsidiary, Operator will waive performance obligations on the part of Licensee to the extent such waiver does not materially and adversely affect Operator's ability to use any Leased Spectrum.

  • Leased space means a self−service storage unit or a space located within a self−service storage facility that a lessee is enti- tled to use for the storage of personal property on a self−service basis pursuant to a rental agreement and that is not rented or pro- vided to the lessee in conjunction with property for residential use by the lessee.

  • Customer Premises means premises owned, controlled or occupied by the Customer which are made available for use by the Supplier or its Sub-Contractors for the provision of the Goods and/or Services (or any of them);

  • Customer Premises Equipment or "CPE" means equipment employed on the premises of a Person other than a Carrier to originate, route or terminate Telecommunications (e.g., a telephone, PBX, modem pool, etc.).

  • Master Tenant means any entity approved by HUD now or hereafter leasing the Healthcare Facility pursuant to a Master Lease.

  • Residential rental property means property that is used solely as leased or rented property for residential purposes. If the property is a space rental mobile home park, residential rental property includes the rental space that is leased or rented by the owner of that rental space but does not include the mobile home or recreational vehicle that serves as the actual dwelling if the dwelling is owned and occupied by the tenant of the rental space and not by the owner of the rental space.

  • Hotel means any establishment used for the purpose of temporary, overnight lodging for which a fee is paid and reservations are required.

  • Leased Assets shall have the meaning ascribed thereto in Section 3.6.

  • The Works/Project means the works to be executed or done under this contract.

  • Space Lease The space or occupancy lease pursuant to which any Borrower holds a leasehold interest in the related Mortgaged Property, together with any estoppels or other agreements executed and delivered by the lessor in favor of the lender under the related Mortgage Loan(s).
