The Living Accommodations granted under this paragraph shall not be of the sam2e µnit type.
The right to reserve Living Accommodations becoming available for occupancy will be alternated between Residents of The Pines who wish to transfer to another Living Accommodation on one hand, and Future Residents who have executed a Future Residency Agreement with the Corporation on the other hand.
Notwithstanding the above, the Corporation reserves the right to fill, in its sole discretion and without regard to the waiting list, up to five (5) vacancies in Living Accommodations each year.
It is expected that filling vacant Living Accommodations pursuant to this paragraph will be rare.
RESIDENT may at his/her own expense make nonstructural alterations to the Living Accommodations (including painting, wallpapering, building of attached bookshelves, carpeting, etc.) only with the prior written approval of NEWBURY COURT.
Upon receiving written notice of termination of this Agreement or upon determining that this Agreement will terminate for any reason, whichever first occurs, NEWBURY COURT will use reasonable efforts to find a new RESIDENT to occupy RESIDENT’S Living Accommodation as quickly as possible, provided, however, NEWBURY COURT shall not be prevented from first filling other unoccupied Living Accommodations.
If two Residents occupying separate Living Accommodations request a transfer to one of the two accommodations, and if the Community approves such transfer, this Agreement shall be terminated and a refund of the Advance Fee as provided herein shall be paid to the Resident.
Any additional amenities or substitutions to the items normally offered in the Living Accommodations shall be at the expense of RESIDENT and be specifically set forth as an addendum to this Agreement.
Should employees be required to use their private vehicle for field trips or similar activities, they will be reimbursed in accordance with the Government Travel and Living Accommodations Directive.
Beginning with the date on which RESIDENT moves in and occupies one of the units in the COMMUNITY (the unit provided to RESIDENT is called the "Living Accommodation”), PROVIDER agrees to make Living Accommodations available to RESIDENT for RESIDENT’S life, together with the facilities, services and medical care provided in this Agreement.
