For the Employee. For purposes of this Section 3, the Contingent Compensation Payments so eliminated shall be referred to as the “Eliminated Payments” and the aggregate amount (determined in accordance with Treasury Regulation Section 1.280G-1, Q/A-30 or any successor provision) of the Contingent Compensation Payments so eliminated shall be referred to as the “Eliminated Amount.”

The parties agree that in the event of any breach or default by the Company of any of the covenants contained herein, and the Company fails to cure such default within ten (10) days following receipt by the Company of written notice thereof, then the Employee shall be entitled to seek any and all remedies available to him under Louisiana law.

35 2. Inform the employee of the allegation of misconduct and that an investigation is being 36 conducted.
37 3. If representation is requested, schedule meetings with the employee when representation is 38 available.
39 4. Notify the employee of the District’s intent to administer discipline at least two days prior to a 40 disciplinary meeting.
41 5. The District will provide the employee with a written statement of the grounds for the 42 disciplinary action. 44 For the Association: 45
46 1. Attempt to notify the Association President that there is an allegation of misconduct and that 47 representation might be requested.
48 a. The District shall notify the Association president when the allegation of misconduct 49 is serious.
1 2. Notify the Association of the District’s intent to administer discipline at least two days prior to
2 a disciplinary meeting.
3 3. The District will provide the Association with a written statement of the grounds for the 4 disciplinary action.
5 4. Allow for review to the Association the investigatory material the District relied upon for the 6 administration of discipline. If requested, investigative material will be provided upon filing a 7 grievance.
