Prior to disbursement of any funds, the Settlement Administrator will provide a disbursement summary of the calculations for the Enhancement Payment to Plaintiff, payment of Attorneys’ Fees and Costs to Class Counsel, LWDA Payment, Administration Costs payment, and payment of Individual Settlement Payments to Settlement Class Members and PAGA Group Members for review and approval by Class Counsel and Defendant’s Counsel.
The entirety of the Settlement Class Fund will be utilized to pay Settlement Class Members, the Class Representatives, Class Counsel Fees and Expenses, the LWDA Payment, Settlement Administrator Fees and Costs or the cy pres beneficiary according to the terms of this Settlement.
The Total Settlement Amount is all-inclusive of all payments contemplated under the Settlement, and will cover: (a) all settlement shares to all Participating Class Members; (b) the LWDA Payment; (c) the Class Representative Service Payments; (d) the Class Counsel Fees and Expenses Payment; and (e) the Settlement Administrator’s fees and expenses.
Fourteen (14) Days after the Funding Date, the Settlement Administrator will mail Settlement Checks to Participating Class Members, Putative Collective Members, and PAGA Members; the LWDA Payment to the LWDA; and any Arbitration fees to the Arbitrator.
Class Counsel intends to request that the Court allocate $9,000.00 to PAGA penalties and approve an LWDA Payment of $6,750.00 (or 75% of the PAGA penalties) to the State of California Labor and Workforce Development Agency.
