PAGA Amount definition

PAGA Amount means the portion paid from the Gross Settlement Amount to resolve the claims for civil penalties under the PAGA, allocated 25% to the Aggrieved Employees ($12,500) and the 75% to LWDA ($37,500).
PAGA Amount means the amount that the Parties have agreed to pay to the Labor and Workforce Development Agency ( LWDA ) and PAGA Members in connection with the Labor Code Private Attorneys General Act of 2004 (Cal. Lab. Code §§ 2698, et seq., PAGA ). The Parties have agreed that One Hundred Thousand Dollars ($100,000) of the Gross Settlement Amount will be allocated to the resolution of any PAGA Seventy- Five Thousand Dollars ($75,000), of the PAGA Amount will be paid to the LWDA ( LWDA Payment ) , and 25%, or Twenty-Five Thousand Dollars ($25,000), of the PAGA Amount will be paid to PAGA Members ( PAGA Member Payment ). The pro rata portion of the PAGA Payment made to PAGA Members shall be determined by dividing the total number of workweeks worked during the PAGA Period into the PAGA Payment made to PAGA Members to arrive at a value per workweek for each eligible PAGA Member. The value per workweek shall be multiplied by the number of workweeks worked by each PAGA Member during the PAGA Period.
PAGA Amount means an amount of $100,000.00, 75% of which ($75,000.00) shall be deducted from the Settlement Fund and paid to the California Labor and Workforce Development Agency (“LWDA”) as a payment of penalties for the claims asserted under PAGA. In connection with settlement approval, the LWDA shall be notified of the existence of the settlement. Should the LWDA object to the amount of this payment, the parties agree to work in good faith to negotiate if possible another agreeable amount to be paid out of the Settlement 2054714.3 - 6 - Fund for this payment of penalties to the LWDA under PAGA, and any amount shall be paid out of the Settlement Fund.

More Definitions of PAGA Amount

PAGA Amount means the allocation of Fifty Thousand Dollars and Zero 10 percent (75%) of the PAGA Amount, or $37,500.00, will be paid to the LWDA (i.e., the LWDA 11 Payment) and the remaining twenty-five percent (25%), or $12,500.00, will be distributed to the 12 PAGA Employees (i.e., the PAGA Employee Amount).
PAGA Amount. As noted above, $15,000 of the NSA has been designated as the “PAGA Amount.” The PAGA Amount will be distributed to all Settlement Class members who worked for Mission Produce in California at any time from April 24, 2019 through <<END OF CLASS PERIOD>> (the “PAGA Period”), based on the proportionate number of pay periods they worked for Mission Produce in California during the PAGA Period.

The Settlement Administrator shall simultaneously pay the withholdings to the applicable authorities with the necessary reports, submitting copies to Defendants’ counsel. For purposes of calculating applicable taxes and withholdings, each Settlement Award shall be allocated as follows: Sixty-Seven percent (67%) as penalties and interest; and Thirty-Three percent (33%) as wages. The Settlement Administrator will be responsible for issuing to participating Settlement Class Members IRS Forms W-2 for amounts deemed “wages” and IRS Forms 1099 for the amounts allocated as penalties and interest. No tax advice has been given to any Settlement Class member. No tax result is guaranteed as related to any payment under this Settlement. Defendants make no representation as to the tax treatment or legal effect of the payments called for under this Settlement Agreement. Each Settlement Class member who receives a Settlement Award will be responsible for correctly characterizing the payment for tax purposes and for payment of any taxes owing on said amount.
