At least twenty-one (21) days, but no more than thirty-five (35) days, prior to the date on which Seller anticipates the Work will achieve Mechanical Completion (the “Anticipated Mechanical Completion Date”), Seller shall provide to Buyer written notice of the Anticipated Mechanical Completion Date.
The Guaranteed Mechanical Completion Date as of the date of this Change Order therefore is January 31, 2008.
The Parties agree that Contractor’s sole remedy for such delay shall be an adjustment to the Guaranteed Mechanical Completion Date pursuant to a Change Order.
