In the event AWVMC refuses to accept or revokes its acceptance of any coal pursuant to this paragraph, Independent Contractor shall have the right to purchase such unacceptable Coal from AWVMC at the point of rejection at a price negotiated by AWVMC and Independent Contractor at the time of rejection. Only upon purchase and payment therefore shall title to such Coal pass to Independent Contractor.

Related to Monthly Designation

  • Beneficiary designation means the naming in a governing instrument of a beneficiary of an insurance or annuity policy, of an account with POD designation, of a security registered in beneficiary form (TOD), of a pension, profit-sharing, retirement, or similar benefit plan, or of another nonprobate transfer at death.

  • Distribution Election With respect to any Series, as specified in the related Supplement.
