SECTION 4.1 As instructed by Seller, Xxxxxxxx shall deliver or cause to be delivered to Seller at the Gas Delivery Point and Oil Delivery Point on an exclusive basis all quantities of Natural Gas and Fuel Oil, respectively, as required by Seller (i) to generate Net Electric Energy and/or Ancillary Services, (ii) to perform Start-Ups, (iii) to perform Shutdowns, and (iv) to operate the Facility during any period other than a Start-Up, Shutdown or Dispatch Period for any reason.
SECTION 11.1 Net Electric Energy delivered by Seller to Xxxxxxxx shall be metered at the Electric Delivery Point, using the Host Utility's Electric Metering Equipment on an hour-by-hour basis, or such shorter intervals as may be necessary to implement this Agreement, are technically feasible using such metering equipment, and are agreed to by the Host Utility.
Except to the extent Fuel Oil is utilized to operate the Facility as set forth in Section 7.2 below, CPS, at its expense, shall deliver or cause to be delivered to Carr xx the applicable Delivery Point, beginning on the Effective Date, all quantities of Gas required by Carr (x) to generate Net Electric Energy and Market Steam and provide Ancillary Services and other Market Output during the Term, and (b) to perform Cold Starts, Warm Starts, and Hot Starts in response to any Dispatch Notice issued by CPS.
Commencing on the Commercial Operation Date, Seller shall sell and deliver, or cause to be delivered, and Buyer shall purchase and receive, or cause to be received, all Net Electric Energy, and concurrently with such sale, Seller shall transfer to Buyer for no additional consideration, all associated Project Capacity and Credits.
If requested, a Party shall provide to the other Party statements evidencing the amounts of Net Electric Energy and/or Market Steam, or the quantities of Gas or Fuel Oil delivered at the applicable Delivery Point, and Carr xxxll provide CPS statements and accounts of all Market Steam Reimbursable Costs incurred hereunder.
Included in the purchase and sale of energy and capacity are all of the Environmental Credits associated with the Net Electric Energy Output.
Seller agrees to operate the Facility in parallel with JCP&L's electric system and, subject to its right to sell electric energy to DuPont if Seller is not an EWG, and except as otherwise agreed in writing by JCP&L, to deliver the Net Electric Energy of the Facility to JCP&L at the Point of Interconnection in the form of three (3) phase, 60 cycle alternating current at 230 KV.

Seller shall not deliver energy or Credits from any other electric generation facility to meet its requirements to deliver Net Electric Energy or Credits pursuant to this Agreement.
Seller shall provide Buyer with a good faith estimate of the updated expected hourly availability for the Project for each hour of the day on which Net Electric Energy is to be delivered one hour prior to the hour in which Net Electric Energy is to be delivered.
