This Clause 49A specifies the respective obligations of the parties in relation to malicious damage to the Facilities during the Operational Term.
If an Emergency arises during the Operational Term which cannot be dealt with by performance of the Services, the Authority may instruct DBFM Co to procure that such additional or alternative services are undertaken by DBFM Co as and when required by the Authority to ensure that the Emergency is dealt with and normal operation of the Facility resumes as soon as is reasonably practicable.
