Owner Indemnified Persons has the meaning given to it in GC 12.1.1.
The Contractor shall indemnify and hold the Owner Indemnified Persons harmless from and against Claims arising out of the Contractor’s performance of the Contract which are attributable to an infringement or an alleged infringement of a patent of invention by the Contractor or anyone for whose acts the Contractor may be liable, and this indemnity shall be deemed to be included in the terms of the indemnity set out in GC 12.1.1.
Contractor will make such certificates and evidence of insurance available to Owner Indemnified Persons prior to commencement of the Work and thereafter upon request.
