Phase II Premises definition

Phase II Premises. The space defined in Section 1.1.
Phase II Premises. All the rentable square footage of “Phase II” of the Property, the size of which shall be determined based on the Approved Working Drawings for Landlord’s Phase II Work (as defined in Exhibit B attached hereto (the “Tenant Work Letter”)) and confirmed through measurement in accordance with Section 1.1.1 (and which shall be measured using the BOMA Standard), which shall be no more than 36,400 rentable square feet, excluding the rentable square footage of the Roof Deck. The outline and general location of the to be constructed Phase II Premises as of the Effective Date is set forth in Exhibit A to this Lease. The rentable square footage shall not include the rentable square footage of the contemplated roof deck for the Phase II Premises (the “Roof Deck”) and no Monthly Rent (as hereinafter defined) shall be payable on the Roof Deck.
Phase II Premises. The date that the Existing Tenant vacates the Phase II Premises and possession thereof is delivered to Tenant, which date is estimated to be April 1, 2022

Examples of Phase II Premises in a sentence

  • For the avoidance of doubt, subject to Xxxxxx’s exercise of the Expansion Option, Tenant’s rights respecting the Phase II Premises shall be limited to the right of access for the sole purpose of constructing the Tenant Improvements, and Tenant shall have no right to otherwise occupy or use the Phase II Premises following completion of the Tenant Improvements respecting the same.

  • Landlord will deliver the Phase I Premises and the Phase II Premises with all HVAC systems in good operating condition on the Phase I Commencement Date and the Phase II Commencement Date.

  • For purposes of documenting the current condition of the FF&E, Tenant and Landlord shall, prior to the Phase I Commencement Date, as to the Phase I Premises, and prior to the Phase II Commencement Date, as to the Phase II Premises, conduct a joint walk-through of the Premises in order to inventory items of damage or disrepair in the FF&E.

  • Landlord and Xxxxxx acknowledge that the Tenant Improvements include the build-out of the Phase II Premises prior to Tenant’s election of the Expansion Option and that, as a result, Tenant may never lease or occupy the Phase II Premises following completion of the Tenant Improvements relating thereto.

  • PREMISES: From the Commencement Date through the day immediately preceding the Phase II Premises Commencement Date, the “Premises” shall consist of the Phase I Premises.


More Definitions of Phase II Premises

Phase II Premises shall be comprised of 29,357 rentable (23,245 usable) square feet of space comprising the fourth (4th) floor of the Building.
Phase II Premises. The Phase II Land and Building and related infrastructure thereon, together with the right and easement to use the infrastructure located in or about other portions of the Office, Research and Development Park from time to time as are necessary to service the Phase II Land and Building, in common with all others entitled thereto.
Phase II Premises means the Phase II Land and the Phase II Building.
Phase II Premises. The “Phase II Premises Term Commencement Date” shall be the date that Landlord tenders possession of the Phase II Premises to Tenant with the Tenant Improvements (as defined below) Substantially Complete (as defined below); provided, however, that if the Phase II Premises Term Commencement Date is delayed by Tenant Delay (as defined below), then the Phase II Premises Term Commencement Date shall be the date that the Phase II Premises Term Commencement Date would have occurred but for such Tenant Delay. A “Tenant Delay” shall mean any act or omission by Tenant that causes a delay in Substantial Completion. Except as expressly set forth in this Lease, if there is an event which Landlord contends is a Tenant Delay, then Landlord shall give Tenant notice of such Tenant Delay (“Tenant Delay Notice”). If Tenant fails to remedy the Tenant Delay within one (1) business day after Tenant’s receipt of a Tenant Delay Notice, then a Tenant Delay shall be deemed to have occurred.
Phase II Premises means the 500,000 square foot area to be constructed by Landlord as an addition to the Building pursuant to Article 3 and labeled as the “Phase II Premises” on the Site Plan, together with that portion of the Common Areas consisting of any parking areas and truck courts expressly reserved for use by the occupant of the Phase II Premises on the Site Plan.
Phase II Premises means the portion of the Premises consisting of the 8th and 9th floors of the Building.
Phase II Premises. The space located in the Building that is unhighlighted (i.e., in white) on Exhibit A attached hereto.
