Phase or Phases definition

Phase or Phases the division of the Land into parcels as generally depicted on Exhibit “A-1” hereto and as referenced in the Takedown Schedule on Exhibit “B” hereto. The “Final Phase,” as such term is used in this Agreement shall mean the last Phase that is required to be purchased pursuant to this Agreement. If the takedown of the Phases is reordered in accordance with the flexibility language included on Exhibit “B,” assuming no permitted termination or default by any of the Parties hereunder, the Final Phase will be the last one of five (5) required to be purchased.

Phase or Phases means a distinct phase (or part of a phase as proposed within a Reserved Matters Application) of the Development shown for indicative purposes on the Phasing Strategy un less othe1wise agreed in writing between the Borough Council and the Owner;

Examples of Phase or Phases in a sentence

• If this Lease is terminated (either entirely or as to one or more Phase) as a result of a Casualty, Tenant or those claiming under Tenant shall use Property Insurance Proceeds to remove all debris from, fill any substantial excavations in and return the Premises, or the applicable Phase or Phases, to a level, safe and vacant condition, and the remaining Property Insurance Proceeds shall be paid to and belong to Landlord).

• If Force Majeure prevents performance by one party of its obligations hereunder in whole or in part for more than thirty (30) days, the other party shall have the right to terminate any remaining Phase or Phases of the Project or the remainder of this Agreement upon written notice to the non-performing party.

• Once the Plan is prepared and completed and one or more Properties are acquired for a Phase or Phases, then as to each Phase to be implemented pursuant to a Phase Affordable Housing Agreement and, as applicable, Phase Implementation Agreement Developer may change and select a different architect for a Phase or Phases, but each new architect shall be subject to the prior approval of Authority and if approved shall then be the Project Architect.

• Client shall pay Consultant the amount set forth in the final invoice which will be equal to the sum of (i) Basic Compensation for Basic Services performed for any Phase or Phases and not yet paid; plus (ii) Additional Compensation not yet paid for Additional Services rendered; plus (iii) reimbursement for Reimbursable Expenses incurred by Consultant and not yet paid; plus (iv) Special Consultant Fees and Reimbursable Expenses not yet paid.
