As of the effective date of this Agreement and while this Agreement is in effect, this Agreement shall supersede the Joint Committee Agreement, as amended, with respect to all matters affecting Plant Hatch or Plant Vogtle.
No portion of any payment made by GPC to Southern Nuclear for costs incurred by Southern Nuclear for participation in industry groups shall be payable by OPC, MEAG or Xxxxxx unless such participation costs when incurred were reasonably expected to yield a present or future benefit, whether direct, indirect, general or specific, to Plant Hatch, the Existing Units or the Additional Units, or Plant Hatch, the Existing Units and the Additional Units.
Sufficient storage capacity currently is available to permit operation into 2003 at Plant Hatch, into 2008 at Plant Vogtle, and into 2010 and 2013 at Plant Farley units 1 and 2, respectively.

In each case where a person or entity has made a claim against the Operating Agent relating to Plant Hatch or Plant Vogtle, the Operating Agent shall notify the Participants in writing within thirty (30) days, provided, however that the Operating Agent need only advise of the general nature of the claim rather than reporting any detail.
Allocated Charges" are all of those costs of Nuclear Operating Services incurred by Southern Nuclear that (i) are not included in the Direct Charges for Each Plant and (ii) equitably should be shared between Plant Hatch and Plant Vogtle or between GPC and any other company or companies for which Southern Nuclear provides services.
No Participant may assign or delegate any of its rights or obligations as such under this Agreement, except in connection with a sale, transfer or assignment of all or any portion of the assignor’s ownership interest in Plant Hatch, the Existing Units or the Additional Units pursuant to the applicable Participation Agreements.
Such price assumes (i) expected cumulative availability (measured in MWh) of [ ]* MWh for Plant Hatch (Units 1 and 2 combined) and [ ]* MWh for Plant Vogtle (Units 1 and 2 combined) for such period, as reflected on Exhibit 4.3.1 hereto.
If Plant Hatch or Plant Vogtle generates Electric Energy in excess of the assumed MWh availability, additional amounts (as described below) shall be payable by Power Marketer to OPC; alternatively, if Plant Hatch or Plant Vogtle generates Electric Energy less than the expected MWh availability, then OPC shall owe additional amounts (as described below) to Power Marketer.
A ten (10) year Fuel Plan for Plant Hatch, the Existing Units and the Additional Units shall be submitted to the Nuclear Managing Board by September 15 of each year.
