  • During the Term, FCE grants POSCO Energy the right to use “FCE” marks, in connection with the labeling, advertising or sale of POSCO Cells and/or POSCO Modules (incorporating POSCO Cells), that POSCO Cells and/or POSCO Modules (incorporating POSCO Cells) made by POSCO Energy are “manufactured under license of FUELCELL ENERGY, INC., U.S.A.”, or any other similar statement, to the extent that such is, in fact, the case.

  • Licensed Software includes error corrections, upgrades, enhancements or new releases, and any deliverables due under a maintenance or service contract (e.g., patches, fixes, PTFs, programs, code or data conversion, or custom programming).

  • Modules means functional applications that comprise the ChannelAdvisor Platform, which Customer may gain access to or obtain Services for by entering into an SOW.
