PREPARATION OF ADVERTISEMENT definition

PREPARATION OF ADVERTISEMENT. The sign shall be manufactured and maintained at Licensee’s sole cost to the standards promulgated by the Superintendent of the York County School Division. Licensor will perform mounting of the sign on the Xxxxxx Field fence. MAINTENANCE OF ADVERTISEMENT: Licensee will perform routine maintenance to repair normal wear and tear of the xxxx board at no cost to Licensor. Licensee shall bear all risk of damage to, or theft of, the sign, Licensee agrees specifically that neither the Licensor nor the York County School Division, shall be liable to Licensee for loss of or damage to the sign occasioned or alleged to be occasioned to any degree, by a failure to secure the confines of Xxxxxx Field or to lock the gate to the surrounding fence. If the advertisement is stolen, or is destroyed or damaged by vandals or acts of God, the Licensee shall bear all costs of repair or replacement and will have the option of having a replacement advertisement, prepared at Licensee’s cost, placed on the fence for the remainder of the duration of this agreement. The replacement advertisement will be posted in the same location as the original advertisement. The term of licenses will be unaffected by posting of a replacement advertisement. Upon expiration of this agreement, and failure to renew, Licensee’s billboard will be removed by Licensor and returned to Licensee. Licensor shall not be responsible for any loss or damage to the billboard that may occur during removal. Licensee herby releases Licensor, its officers, agents and employees from all liability arising out of Licensor’s removal of Licensee’s billboard at any time during the term of this agreement.
