This confidential and privileged information is vital and essential to Consultant in order that Consultant adequately design the project at hand on behalf of State.

The Consultant and the LPA agree that any unauthorized dissemination of any privileged or confidential information or documentation on the part of the Consultant will create liability on the part of the Consultant to the LPA for any damages that may occur as a result of the unauthorized dissemination.
